Subject field(s)

  • Law of Evidence
CONT

Formerly, if there was a scintilla of evidence to support the issues, the judge was bound to leave it to the jury; but now, in every case, it is for the judge to decide whether there is any evidence from which the jury can reasonably find for the party on whom the burden of proof rests. It there is no evidence or a mere scintilla, it is his duty to withdraw the case from the jury and enter judgment for the opposite party. And the test whether evidence only amounts to a scintilla is to assume it uncontradicted, and then inquire whether the jury would be justified in founding a verdict thereon.(Phipson, 13th ed., 1982, p. 765)

CONT

Scintilla of evidence has been defined as "any material evidence that if true would trend to establish the issue in the mind of a reasonable juror." Other views are that a scintilla of evidence is no evidence or but a spark, gleam, or mere conjecture as distinguished from a reasonable inference. The expression "mere scintilla" of evidence means the least particle of evidence - evidence which, without further evidence, is a mere trifle. "More than a scintilla" may be defined as evidence of probative value having the fitness to induce conviction in the minds of reasonable men. (Corpus juris secundum, 1981, vol.32A, p.628)

DEF

One of the most ancient forms of trial in England that required the accused person to submit to a dangerous or painful test on the theory that God would intervene and disclose his or her guilt or innocence.

CONT

Trial by ordeal is a judicial practice by which the guilt or innocence of the accused is determined by subjecting them to a painful task. In some cases, the accused was considered innocent if they survived the test, or if their injuries healed; in others, only death was considered proof of innocence.(If the accused died, they were often presumed to have gone to a suitable reward or punishment in the afterlife, which was considered to make trial by ordeal entirely fair).

Once a valid application for National Listing is accepted, seed of the variety will be requested for tests and trials designed to assess whether the variety is distinct, uniform and stable (DUS) and, in the case of agricultural crops, whether it has value for cultivation and use (VCU).

CONT

In many countries, variety registration also requires proof of adaptation to certain growing conditions and a test of the variety's processing and use characteristics. These Value for Cultivation and Use(VCU) tests involve multi-locational testing, determination of yield and yield-components, such as disease resistance, in comparison to the already existing varieties. Depending on the crop, VCU tests include certain use characteristics, such as cooking time of legumes, baking quality of wheat and digestibility of fodder.

Liability to capture. It was Lord Stowell who introduced in prize law the rule that forfeiture of the neutral vessel can only follow upon proof of knowledge by the shipowner of the contraband nature of the cargo. The true test of liability to capture was, in Lord Stowell' s view, the state of mind of the neutral claimant :... The Declaration of London elected to rest the principle of confiscation not on the knowledge of the owner, but on the relative proportion of contraband to the whole cargo. The ship is involved in all cases where she carries contraband goods which either in value, weight, quantity or freight exceed half of the whole cargo...
