Matters of title are subdivided, at common law, into matters going to the root of title and other matters of title.... Howland defines a matter going to the root of title as one which would result in a total failure of consideration. The purchaser would receive nothing at all, not even possession of the property.(Anger and Honsberger, 2nd, p. 1130)

CONT

Our substantive law is still that developed from the action of ejectment, so that today it is still true that possession is a root of title.(Megarry and Wade, p. 1006)

Requisitions on title... may be further subdivided into requisitions going to the root of the title and other requisitions on title... The relevance of the distinction lies in the application of the clause limiting the time within which requisitions may be made. Where the requisition does not go to the root of title this provision tends to be applied strictly. Where, on the other hand, the requisition does go to the root of title, the requisition may be made after the time stipulated by the contract and the provisions of the contract will not result in the purchaser being deemed to have accepted the defect in question.(Law Society of Upper Canada, Bar Admission Course, Real Estate Law, 1990-1991, p. 8-2).

Muniments of title. Documentary evidence of title. The instruments of writing and written evidences which the owner of lands, possessions, or inheritances has, by which he is enabled to defend the title of his estate. The records of title transactions in the chain of title of a person purporting to create the interest in land claimed by such person and upon which he relies as a basis for the marketability of his title, commencing with the root of title and including all subsequent transactions. Under "muniment of title doctrine" when ownership of property has been litigated between individuals and title has been adjudicated in one of the parties, the losing party cannot relitigate the matter with those who rely upon the title of the winning party.(Black's 6th ed., p. 1019).
