An agreement, convention, or promise of two or more parties, by deed of writing, signed, and delivered, by which either of the parties pledges himself to the other that something is either done, or shall be done, or shall not be done, or stipulates for the truth of certain facts. At common law, such agreements were required to be under seal. The term is currently used primarily with respect to promises in conveyances or other instruments relating to real estate.

[T] hat which contains the particulars of a deed, etc., and is the instrument registered, in the case of a deed which must be registered. The registration of a deed or other document is effected by leaving it at the registry together with a memorial under the hand and seal of one of the parties to the deed. The memorial is an abstract of the material parts of the deed, with the parcels at full length, and concludes with a statement that the party desires the deed to be registered. The execution of the deed and memorial is proved by the oath of an attesting witness.(Jowitt, 2nd ed., 1977, p. 1171).

To this point, the words ’enrollment’, ’registration’, and ’recording’ have been used interchangeably. The "Statute of Enrollments" required enrollment, and the "Middlesex Act" required registration. Both of these procedures are the same and are satisfied by a memorandum or memorial included in the public records stating the names of the grantor and of the grantee of the instrument, and the interest purportedly transferred. Recording requires that a complete copy of the instrument be included in the public records. (Mapp, 1978, p. 48).

The doctrine of "escrow" is a relic of medieval times. It dates from the time when conveyances were made by feoffment and livery of seisin. It has survived to the present day and often operates in regard to conveyances of land or the creation or disposition of estates and interests in land such as a term of years.... It does predicate a document which is executed and delivered. The accustomed formula is "signed, sealed and delivered". When that formula is used in the document and it is signed by the party(or in the case of a company its seal is affixed) and attested by a witness with intent by the maker that it should be binding on him, it is conclusively presumed to be "signed, sealed and delivered". If it is handed over to another unconditionally, it is delivered as a deed. If it is handed over to another conditionally, it is delivered as an escrow. It only becomes a deed when the conditions are fulfilled....(Words and Phrases/England, v. 2, p. 173)
