THERE IS PRIMA FACIE [10 records]

Record 1 2018-07-25

English

Subject field(s)
  • Penal Law
  • Practice and Procedural Law
CONT

A reasonable prospect of conviction requires that there be more than a bare "prima facie" case, or in other words, it requires more than evidence that is capable of making out each of the necessary elements of the alleged offence against an accused. However, the test does not require a probability of conviction, that is, it does not require a conclusion that a conviction is more likely than not.

French

Domaine(s)
  • Droit pénal
  • Droit judiciaire
CONT

CONT

A grand jury is meant to be part of the system of checks and balances, preventing a case from going to trial on a prosecutor's bare word. A prosecutor must convince the grand jury, an impartial panel of ordinary citizens, that there exists reasonable suspicion, probable cause, or a prima facie(legally sufficient) case that a crime has been committed.

OBS

At one time, it used to be widely thought that a combination to injure was not actionable, unless it was inspired by malice or "disinterested malevolence". But as now formulated, a combination to injure another is prima facie actionable unless there is some justification recognized by law. Thus the critical issue is the object or purpose of those acting in concert.
