Its purpose is to restore an offender to compliance with the CEPA 1999 as quickly as possible. EPCOs may be issued to : prevent a violation from occurring; stop or correct a violation that is occurring or continues to occur; and correct an omission where conduct is required by CEPA 1999 or one of its regulations, but is not occurring. 3, record 24, English, - environmental%20protection%20compliance%20order

2, record 24, French, - ordre%20d%27ex%C3%A9cution%20en%20mati%C3%A8re%20de%20protection%20de%20l%27environnement

Under the general law of contract, said Lord Wilberforce, acceptance of a repudiatory breach does not bring about rescission ab initio’. It follows, therefore, that if an innocent party, the victim of a breach of contract that is sufficiently important, chooses to treat the contract as discharged, for example, where goods sold to a buyer are defective and the buyer rejects them, his conduct is not to be looked upon as involving rescission of the contract. 2, record 27, English, - rescission%20ab%20initio

It is aimed at providing opportunities for such researchers to, under the guidance of their hosts, conduct cooperative research with leading research groups in universities and other Japanese institutions, thereby permitting them to advance their own research while stimulating Japanese academic circles, particularly young Japanese researchers, through close collaboration in scientific activities. Such collaboration is also intended to advance scientific research in the counterpart countries.(Fellowships are awarded for a period of 12 to 24 months.) The offence of being a common scold has become obsolete in the United States because only women could commit it, contrary to current interpretations of the Equal Protection Clause, and because in any case all crimes must be statutory under current interpretations of the due process clause in the Fourteenth Amendment of the constitution of the United States. Many states have laws or ordinances restricting public profanity, sometimes blasphemy, excessive noise, or verbal disorderly conduct. The standard of care that the court must apply in medical malpractice cases is not one of perfection; but rather is to require the physician to conduct him or herself within a reasonable degree of skill and knowledge. This includes skill and care with respect to diagnosis, and treatment of the patient's medical condition. It is an objective standard and varies according to the level of the experience attained by the physicians whose performance is under consideration. 2, record 76, English, - reasonable%20degree%20of%20skill%20and%20knowledge

These measures, among other things, provide for the complete protection of certain species designate specified areas as whale sanctuaries; set limits on the numbers and size of whales which may be taken; prescribe open and closed seasons and areas for whaling; and prohibit the capture of suckling calves and female whales accompanied by calves. ISAS utilizes "aerodynamic lifting bodies" to conduct space research and observations, and is developing launch vehicles and satellites for such purposes. In its former guise as part of Tokyo University Institute of Industrial Science in 1955, the organization conducted the horizontal flight tests of pencil rockets, and as Tokyo University Aerospace Research Center, it launched Japan's first artificial satellite, Ohsumi, in 1970. These entities disappeared in 1981 in a "progressive amalgamation" under the direct control of the Ministry of Education. In the province of New Brunswick, Social Service, Educational and Mental Health agencies felt that a group of multi-agency, regionally based clinical teams would have the best chance of creating the kind of care plans that would be most acceptable to the youth and his/her family, as well as to the school and community. With these facts in mind, they developed and implemented a provincial system entitled the Youth Treatment Program(YTP). The provincial Youth Treatment Program is geared to serve severely conduct disordered youths(18 years and under) who have experienced loss in family life and have faced difficulties in both school and community settings. 1, record 96, English, - Youth%20Treatment%20Program

1, record 96, French, - Programme%20de%20traitement%20pour%20jeunes

An «implied contract» is inferred by the law as a matter of reason and justice from the act or conduct of the parties. An implied contract may arise where one party, without being requested to do so, renders services under circumstances indicating that he or she expects to be paid thereof, and the other party knowing the circumstances, avails himself of the benefit of those services. An implied contract is an agreement which legitimately can be inferred from the intention of the parties as evidenced by circumstances and ordinary course of dealing and common understanding.(Black's Law Dictionary, cited in note 16 of section 5. 16. 5 of the "Guide de la détermination de l'admissibilité"). 1, record 99, English, - implied%20contract%20of%20service
