Courts have used the word "consideration" with many different meanings. It is often used merely to express the legal conclusion that a promise is enforceable. Historically, its primary meaning may have been that the conditions were met under which an action of assumpsit(an early form of contract action) would lie. It was also used as the equivalent of the "quid pro quo" required in an action of debt. A seal, it has been said, imports a consideration, although the law was clear that no element of bargain was necessary to enforcement of a promise under seal. On the other hand, consideration has sometimes been used to refer to almost any reason asserted for enforcing a promise, even though the reason was insufficient(as in) promises in consideration of love and affection, illegal consideration, past consideration, and consideration furnished by reliance on a gratuitous promise where in fact there has been no consideration at all.(Yogis, 1983, p. 47). 2, record 26, English, - consideration

The general rule is that a promise to perform an existing duty is no consideration, at least when the promise is made by a party to a pre-existing contract, when it is made to the promisee under that contract, and it is to do no more than the promisor is bound to do under that contract. In order to model the progress of an epidemic in a large population, the population diversity must be reduced to a few key characteristics which are relevant to the infection under consideration. For example, for most common childhood diseases that confer long-lasting immunity, it makes sense to divide the population into those who are susceptible to the disease, those who are infected and those who have recovered and are immune. These subdivisions of the population are called compartments... The SIR model labels these three compartments S=number susceptible, I=number infectious, and R=number recovered(immune). This is a good and simple model for many infectious diseases including measles, mumps and rubella. 4, record 48, English, - susceptible%2Dinfected%2Drecovered%20model

[The Kermack-McKendrick model] was proposed to explain the rapid rise and fall in the number of infected patients observed in epidemics such as the plague (London 1665-1666, Bombay 1906) and cholera (London 1865). It assumes that the population size is fixed (i.e., no births, deaths due to disease, or deaths by natural causes), incubation period of the infectious agent is instantaneous, and duration of infectivity is same as length of the disease. It also assumes a completely homogeneous population with no age, spatial, or social structure. 3, record 48, English, - susceptible%2Dinfected%2Drecovered%20model

A voluntary purchaser or volunteer is one who does not give valuable consideration in return for the acquisition of the interest in land concerned. Volunteers comprise donees and beneficiaries(whether devisees or persons entitled to residue or on intestacy) of estates of deceased persons, as well as beneficiaries under settlements made "inter vivos", and also persons in whom property is vested in a representative capacity without consideration being given, for example, where a new trustee is appointed or property vests in a personal capacity.(A Working Paper of the Law Reform Commission on a Bill in Respect of an Act to Reform and Consolidate the Real Property Acts of Queensland, p. 66). 1, record 52, English, - voluntary%20purchaser

An option may be described as a right usually acquired by contract to accept or reject a continuing offer within a prescribed period. When supported by consideration it constitutes an irrevocable offer binding on the grantor of the option. The person in whose favour it is made, the grantee, assumes no obligations. An option to purchase land, for instance, is not a contract for the sale and purchase of land. Under the latter one party is bound to sell and the other is bound to buy, whereas an option simply gives the grantee a right to purchase without any obligation to do so.(Barnsley, p. 1) 1, record 57, English, - option

In English law, a promise is not, as a general rule, binding as a contract unless it is either made under seal or supported by some "consideration". The purpose of the doctrine of consideration is to put some legal limit on the enforceability of agreements even where they are intended to be legally binding and are not vitiated by some factor such as mistake, misrepresentation, duress or illegality.... The present position therefore is that English law limits the enforceability of agreements not under seal by reference to a complex and multifarious body of rules known as "the doctrine of consideration. After some hesitation it was settled in 1565 that if a tenant in fee simple covenanted to stand seized of his land in favour of some near relative, the "good consideration" of natural love and affection sufficed to raise a use in favour of the relative; the use was then executed and the legal estate vested in the relative. This type of conveyance was of limited application as it could not be employed to convey land to strangers, and, like the bargain and sale enrolled, it could not carry any further uses under the Statute.(Megarry and Wade, 4th ed., 1975, p. 165) 1, record 59, English, - covenant%20to%20stand%20seized%20of%20land

"Canadian maritime law" as defined in s 2 of the Federal Court Act is a comprehensive body of federal law dealing with all claims in respect of maritime and admiralty matters. The scope of Canadian maritime law is not limited by the scope of English admiralty law at the time of its adoption into Canadian law in 1934. Rather, the word "maritime" is to be interpreted within the modern context of commerce and shipping, and the ambit of Canadian maritime law should be considered limited only by the constitutional division of powers in the Constitution Act, 1867. The test for determining whether a subject matter under consideration is within maritime law requires a finding that the subject matter is so integrally connected to maritime matters as to be legitimate Canadian maritime law within federal competence 2, record 71, English, - Canadian%20maritime%20law

2, record 71, French, - droit%20maritime%20canadien

An increase in wages or salary means that the wage or salary amount is augmented, enlarged, or expanded. This implies that an amount was added to the wages or salary, therefore, constituting a newly agreed rate of pay for the work performed. Often an increase of salary is given retroactively. This occurs during contract renewal where workers continue to perform their duties at their former rate of pay while the contract is being negotiated. When the contract is finally signed and there is a new agreement as to an increased salary level, that new salary is often effective at an earlier date. In this case, payment must be made retroactively to compensate for the difference under the old contract and the increased salary level under the new contract. In other cases, an employer may unilaterally give an increase in salary that may also be retroactive. These retroactive increases in wages or salary are specifically excluded from consideration as earnings. 5, record 77, English, - retroactive%20pay%20increase

7, record 77, French, - augmentation%20r%C3%A9troactive%20de%20salaire

Of the ministère des Transports of Québec. This policy deals with the selection of pavement types. It covers a five-year period and is a core component of our road system management policy. Comprehensive in approach rather than project-based, it set outs the most appropriate types of pavement for roads under the Department's jurisdiction. The analysis methodology it stipulates is a thorough, proven approach based on consistent, verifiable parameters and a transparent development process throughout. The new policy, which replaces the Policy on the Construction and Maintenance of Cement Concrete pavements in force since 1995, allows greater consideration of new technologies and road work requirements through its integrated approach under a comprehensive Québec pavement management framework. Implementation of this policy must fit with road work planning strategies and the Department's financial capabilities. In drawing up this new policy, the Department met with representatives of the concrete and asphalt industries as well as the Association des constructeurs de routes et grands travaux du Québec(Québec' s road builders’ association) in order to take their views into account. 1, record 94, English, - Departmental%20Policy%20on%20pavement%20type%20selection

1, record 94, French, - Orientation%20minist%C3%A9rielle%20sur%20le%20choix%20des%20types%20de%20chauss%C3%A9e
