Standing Offers. Standing Offers are used to meet recurring needs when departments or agencies repeatedly order the same goods or services. A request for standing offer(RFSO) is used to solicit standing offers. Suppliers who meet the evaluation criteria stated in the RFSO become pre-qualified suppliers and holders of standing offers. A standing offer is an offer from a potential supplier to provide goods and/or services at pre-arranged prices, under set terms and conditions, when and if required. It is not a contract until the government issues a "call-up" against the standing offer. The government is under no actual obligation to purchase until that time. 2, record 7, English, - request%20for%20standing%20offer

A further type of standard charter party form is the private form(sometimes called a ’house charter party’), which is issued and employed by individual firms. One of the main advantages from the use of such forms is that often the parties to a charter contract are domiciled in different countries and that the negotiations, which to a great extent are carried out through the intermediary of one or several brokers, are often performed under considerable time pressure. 2, record 28, English, - private%20form

In North American sports contracts, waivers is a type of player transaction. A player under contract to a team is placed on "waivers" for a specified period of time; during this time other teams may submit a claim for that player's contract. Based on a priority system, the team with the highest priority earns either the right to negotiate with the player's current team, or in some cases, the right to assume the contract of that player from the current team. Each of the four major league sports has somewhat different procedures for handling waivers. 1, record 29, English, - waivers

Under the general law of contract, said Lord Wilberforce, acceptance of a repudiatory breach does not bring about rescission ab initio’. Courts have used the word "consideration" with many different meanings. It is often used merely to express the legal conclusion that a promise is enforceable. Historically, its primary meaning may have been that the conditions were met under which an action of assumpsit(an early form of contract action) would lie. It was also used as the equivalent of the "quid pro quo" required in an action of debt. A seal, it has been said, imports a consideration, although the law was clear that no element of bargain was necessary to enforcement of a promise under seal. On the other hand, consideration has sometimes been used to refer to almost any reason asserted for enforcing a promise, even though the reason was insufficient(as in) promises in consideration of love and affection, illegal consideration, past consideration, and consideration furnished by reliance on a gratuitous promise where in fact there has been no consideration at all.(Yogis, 1983, p. 47). 2, record 79, English, - consideration

In a simple contract arising from agreement, it is sometimes of the essence of the transaction that each party should be bound to do something under it : this requirement is called mutuality; thus, an agreement by A to refer a question between himself and B to arbitration is not enforceable unless B also agrees to be bound by the award; and an agreement by C with D to learn a trade is not binding unless there is also an undertaking by D to teach him. This may be called mutuality of obligation. 1, record 91, English, - mutuality%20of%20obligation
