A Convention refugee is a person who, by reason of a well-founded fear of persecution for reasons of race, religion, nationality, membership in a particular social group or political opinion,(a) is outside each of their countries of nationality and is unable or, by reason of that fear, unwilling to avail themself of the protection of each of those countries; or(b) not having a country of nationality, is outside the country of their former habitual residence and is unable or, by reason of that fear, unwilling to return to that country.

The principle of voluntariness is the cornerstone of international protection with respect to the return of refugees. While the issue of voluntary repatriation as such is not addressed in the 1951 Refugee Convention, it follows directly from the principle of non-refoulement : the involuntary return of refugees would in practice amount to refoulement. A person retaining a well-founded fear of persecution is a refugee, and cannot be compelled to repatriate.

The Swedish Aliens act sets out the categories of people who are entitled to proctection in Sweden. Clarity, credibility and humanity are the watchwords of the legislation. A person who feels a well-founded fear of persecution on grounds of race, nationality, membership of a particular social group, or religious or political conviction is given asylum under the Geneva Convention. Others in need of protection are those who risk capital punishment, torture or other inhuman or degrading treatment or punishment, those who are fleeing from internal or external armed conflict or environmental disaster, and those who are subject to persecution because of their gender or homosexuality. In mass migration situations the Government can authorise temporary two-year residence permits.
