The possession of a right is acquired by use, as where an owner, being present and cognizant of the matter, by acquiescence permits a neighbour, who has no right to do so, to use some servitude in his unencumbered estate(as that of pasturing cattle, a right of passage, a right to drive beasts or of conducting water or the like) for a long time, peacefully and without interruption, so that the user cannot be ejected without writ and judgment. 4, record 3, English, - possession%20of%20a%20right

Escheat therefore being a title frequently vested in the lord by inheritance, as being the fruit of a signiory to which he was entitled by descent, it may seem in such cases to fall more properly under the head of acquiring title to estates, viz, by descent, by purchase. But it must be remembered that, in order to complete this title by escheat, it is necessary that the lord perform an act of his own, by entering on the lands and tenements so escheated, or suing out a writ of escheat, on failure of which, or by doing any act that amounts to an implied waiver of his right, as by accepting homage or rent of stranger who usurps the possession, his title by escheat is barred. It is therefore in some respect a title acquired by his own act, as well as by act of law.(Blackstone, Book II, p. 244) 1, record 5, English, - title%20by%20escheat

Record number: 7, Textual support number: 1 OBS
This was the name, in English practice, of a writ of execution first given by the statute of Westm. 2 (13 Edw. I, c. 18) either upon a judgment for a debt or damages or upon the forfeiture of a recognizance taken in the king’s court. It was so called because it was in the choice or election of the plaintiff whether he would sue out this writ or a fi. fa. By it the defendant’s goods and chattels were appraised and all of them (except oxen and beasts of the plow) were delivered to the plaintiff, at such reasonable appraisement and price, in part satisfaction of his debt. 3, record 7, English, - elegit

2, record 7, French, - mise%20en%20possession
