CONT

As the rule permitting the introduction of past recollection recorded developed, it required that four elements be met :(1) the witness must have had firsthand knowledge of the event,(2) the written statement must be an original memorandum made at or near the time of the event and while the witness had a clear and accurate memory of it,(3) the witness must lack a present recollection of the event, and(4) the witness must vouch for the accuracy of the written memorandum.(McCormick, p. 712)

OBS

Where a witness cannot recall the event described in the notes, even after reading them, and cannot testify from a present memory, the notes themselves may be admitted as evidence of their contents. (Fed./Prov. Task Force, p. 283)

Record 3 2013-09-11

English

CONT

Although the witness would be unable to testify about the events, the writing itself may be admissible as evidence of its contents, if the witness can lay a foundation by establishing the criteria for "past recollection recorded". The four requirements are :(a) the witness must have had first hand knowledge of the event;(b) the written memorandum must be an original memorandum made at or near the time of the event while the witness had a clear and accurate memory of it;(c) the witness must lack a present recollection of the event; and(d) the witness must vouch for the accuracy of the written memorandum.

CONT

Clearly something used to revive a witness’s present recollection is not itself evidence of the event recalled but a mere catalyst; the evidence is the witness’s oral testimony based on his newly-revived memory. (Schiff, Evidence in the Litigation Process, p. 190)

CONT

The witness must testify from his present memory of the event and not from the contents of a writing used to revive it.

  • Diplomacy
DEF

An informal summary of a diplomatic conversation or interview between a diplomatic representative or officer and the head or an officer of the foreign office or another mission.

CONT

The only other formal communication used is the aide-mémoire or memorandum, which is a written statement handed in the course of a personal discussion with the object of recording, for the convenience of the other party, the details of a possibly complicated or involved matter.

OBS

It [aide memoire] is supposed, as its name implies, to serve as a reminder of points covered in the conversation. In practice it is left by the diplomatic officer with the Foreign Office or with the other mission. It does not begin with the usual phrases of courtesy of the note verbale, but its first lines should identify the sender of the note and the receiver. It is initialed by the sender.

CONT

A voluntary policy occurs when a company, organization, or other group determines that it will implement a smoke-free policy even though it may be allowed to permit smoking by law. These policies are pacts that outline conditions, expectations, or obligations without the force of law. They may be written as a memorandum of understanding that clearly spells out the conditions of the agreement. Getting solid agreement still requires research and organization.
