In response to shifts in market demand, in recent years, some hybrid dispute resolution procedures, such as Med-Arb [Mediation-Arbitration]... have been developed.... Med-Arb... as the name suggests, is a hybrid dispute resolution mechanism that consists of a combination of mediation and arbitration. Typically... the parties agree that the process will begin as a private mediation and if they are unable to reach a mediated agreement in the end, the process shifts to arbitration.

Combined or hybrid dispute resolution processes are processes in which the dispute resolution practitioner plays multiple roles. For example, in conciliation and in conferencing, the dispute resolution practitioner may facilitate discussions, as well as provide advice on the merits of the dispute. In hybrid processes, such as med-arb [mediation-arbitration], the practitioner first uses one process(mediation) and then a different one(arbitration).

... the court found that requiring a retired judge to conduct the arbitration as opposed to an institutional arbitrator, who is subject to rules and procedures that ensure neutrality, was problematic. Were such a selection process permissible, a corporation could define the procedures for arbitrator selection in an unfair manner and avoid the oversight of an institutional arbitrator who would require more balanced rules, thus creating a regime that leaned in its favor.

If a collective agreement cannot be achieved through negotiations, with or without the assistance of a mediator, voluntary interest arbitration can be considered. This option is available at any time during the collective bargaining negotiation process. This applies to any kind of bargaining, public or private sector, whether the right to strike/lockout exists, whether there are significant differences between the parties, and whether a dispute strike/lockout is imminent or underway. Both parties must agree to this process. Arbitration is binding. This means the parties must abide by, and live with the arbitration decision.

The Canadian Insurance Claims Managers Association(CICMA) was first established in 1952 as an organization to allow claims managers to : promote and enhance the image and general welfare of the general insurance industry in the matters pertaining to the settlement of claims; develop harmonious relations amongst those people engaged in the direction of or the investigation and adjustment of claims; exchange information and discuss matters of common interest; promote and maintain a high standard of ethics in the handling of general insurance claims; further such claims administration as will result in just and proper settlement of meritorious claims; promote arbitration or mediation in the resolution of claims. In order to promote the arbitration process as a cost effective way to resolve inter company disputes, the CICMA is also directly responsible for the administration of the Canadian Inter-Company Arbitration Agreement.
