This desire to heal relations is demonstrated by the parties abandoning their own subjective laws. Equity arbitration relies on both equitable ideals and universal common law principles that have developed through the years. For example, a valid contract requires that one party made an offer, the other accepted it, and something of value was exchanged. If the parties never reached an agreement, there is no contract... In equitable arbitration, the arbitrator doesn’t have to follow legal technicalities or enforce parts of a contract that don’t make sense. The American Arbitration Association(AAA) is one of several arbitration organizations that administers arbitration of disputes brought to it by members of the public. The AAA also administers mediation and other forms of alternative dispute resolution. Many contracts include an arbitration clause naming the AAA as the organization that will administer an arbitration between the parties. The AAA does not itself arbitrate disputes, but provides administrative support to arbitrations before a single arbitrator or a panel of three arbitrators.
