DEF

The doctrine that, in a bailment, both the bailor and the bailee have possession of the item that has been bailed.

OBS

The theoretical justification for this is the doctrine of "double possession" - a principal may have possession through the possession of an agent. This view is in accord with some foreign systems, but it does not suit the basic principles of English law which treats possession as exclusive.

DEF

An interest in property other than full ownership, such as that of a bailee in possession, a lienor, a mortgagee, etc. (Ballentine’s, 3rd ed., 1969, p. 1201)

OBS

"Special property"... may mean that the subject-matter is incapable of being in the absolute ownership of any person. Thus a man may have a property in deer in a park, hares or rabbits in a warren, fish in a pond, etc. ;but it is only a special or qualified property, for if at any time they regain their natural liberty his property instantly ceases, unless they have "animus revertendi".(A) person may have a special property in a thing in the sense that he can only put it to a particular use. Thus, in the case of a bailment, the bailee has a special property in the thing bailed, for he is only entitled to deal with it in accordance with the... bailment....(Jowitt's, 2nd ed., 1977, p. 1447)

Subject field(s)

DEF

The rights or interests a person has in the thing he or she owns.

OBS

... In modern understanding, however, property has come to mean the thing itself to which certain ownership rights are attached. (Reilly, 1977, p. 338).

OBS

In its largest sense property signifies things and rights considered as having a money value, especially with reference to transfer or succession, and to their capacity of being injured. Property includes not only ownership, estates, and interests in corporeal things, but also rights such as trade marks, copyrights, patents, and rights "in personam" capable of transfer or transmission, such as debts. (Jowitt’s, 2nd ed., 1977, p. 1447).

OBS

"Property" is a word of different meanings. It may mean a thing owned.... It may mean ownership itself as when I speak of my "property" in my watch which may pass to the person to whom I sell the watch before I actually hand the watch over.... Or it may even mean an interest in a thing less than ownership but nevertheless conferring certain rights, as when we speak of the "property" or "special property" of a bailee in the thing bailed.... "Property" comprehends tangibles and intangibles, movables and immovables; it means a tangible thing(land or a chattel) itself, or rights in respect of that thing, or rights, such as a debt, in relation to which no tangible thing exists.(Crossley Vaines, 5th ed., 1973, p. 3).

English

Subject field(s)
  • Oil Drilling
  • Ground-Drilling Facilities (Mining)
DEF

The percussion method of drilling, whereby a heavy bit makes hole by a pounding action.

CONT

Cable-tool drilling consists in pulverizing the rock formation a little at a time by alternately raising and dropping a heavy cutting tool called a bit, thereby driving a hole into the earth. Water must be present in the bottom of the hole to keep the rock fragments in suspension, and from time to time the excess water and rock particles must be bailed out.

CONT

Early wells were drilled with impact-type tools, in a method called cable-tool drilling, in which a chisel-like bit was suspended from a cable to a lever at the surface, and an up-and-down motion of the lever caused the bit to pound the bottom of the hole and chip away the rock. Such drilling had to be interrupted periodically to allow loose rock chips to be removed with a basket-like device.

OBS

It has largely been replaced by rotary drilling.

Domaine(s)
  • Forage des puits de pétrole
  • Installations de forage minier
CONT
