This state of the law sometimes causes dissatisfaction, particularly when it is alleged that "excessive" profits have been made out of government contracts; or, when, in times of scarcity, it is said that "excessive" prices are charged for goods or services or accommodation. Courts have used the word "consideration" with many different meanings. It is often used merely to express the legal conclusion that a promise is enforceable. Historically, its primary meaning may have been that the conditions were met under which an action of assumpsit(an early form of contract action) would lie. It was also used as the equivalent of the "quid pro quo" required in an action of debt. A seal, it has been said, imports a consideration, although the law was clear that no element of bargain was necessary to enforcement of a promise under seal. On the other hand, consideration has sometimes been used to refer to almost any reason asserted for enforcing a promise, even though the reason was insufficient(as in) promises in consideration of love and affection, illegal consideration, past consideration, and consideration furnished by reliance on a gratuitous promise where in fact there has been no consideration at all.(Yogis, 1983, p. 47). 2, record 31, English, - consideration

A fifth method of conveying was the lease and release. The lease for a term of years, since it was not a freehold, was usually made by deed. In order to perfect his interest, the lessee did, however, have to enter on the land, for otherwise the deed gave him only an "interesse termini", or interest in the term. Once the tenant had gone into possession, he was capable of taking a release, that is, the landlord could release the reversion to him by deed and the two interests would merge so as to give the tenant the fee simple and the seisin.... In England the feoffment with livery as well as the other old forms of conveyance, the bargain and sale and the lease and release, have been abolished. The latter two forms of conveyance, provided they are by deed, are still possible in Canadian jurisdictions which have legislation similar to Ontario's, since that legislation only deals with feoffment by livery.(Anger & Honsberger, 2nd ed., 1985, pp. 34 et 96) 1, record 45, English, - lease%20and%20release

Innocent conveyances, a covenant to stand seised, a bargain and sale, and a release, so called because, since they conveyed the actual possession by construction of law only, they did not confer a larger estate in property than the person conveying possessed, and therefore, if a greater estate was conveyed by these deeds than a person had, they were only void "pro tanto" for the excess. But a feoffment of such larger estate was a tortious conveyance, and therefore, under such circumstances, would have been void altogether, and produce a forfeiture. But the "Real Property Act", 1845, s. 4, provided that a feoffment should not have any tortious operation; it therefore became an innocent conveyance.(Jowitt, p. 978) 1, record 46, English, - innocent%20conveyance

After some hesitation it was settled in 1565 that if a tenant in fee simple covenanted to stand seized of his land in favour of some near relative, the "good consideration" of natural love and affection sufficed to raise a use in favour of the relative; the use was then executed and the legal estate vested in the relative. This type of conveyance was of limited application as it could not be employed to convey land to strangers, and, like the bargain and sale enrolled, it could not carry any further uses under the Statute.(Megarry and Wade, 4th ed., 1975, p. 165) 1, record 48, English, - covenant%20to%20stand%20seized%20of%20land

If V contracted to sell land to P, and P paid the price (which at first had to be the full value, but later might be nominal, e.g., twelve pence or a peppercorn), V was said to have "bargained and sold" the land to P. Equity deemed V to be seised to the use of P, much as today V is said to be trustee for P until the land is duly conveyed in accordance with the contract. The use was then executed and P took the legal estate both secretly and without entry on the land. (Megarry and Wade, p. 165) 1, record 52, English, - bargain%20and%20sell

Bargain and sale. Generally applies to land and refers to a contract for the sale of any estate or interest in real property or chattels followed by payment of the agreed purchase price. The phrase is also applied to transfer of personalty where there is an executory agreement of sale followed by a completed sale. Formerly, the Court of Chancery held that after a bargain and sale the vendor held the land to the use of, or for the benefit of, the purchaser. In 1536 the Statute of Uses executed the use in favour of the purchaser, thus giving him the same interest in the land as the vendor had. However, bargain and sale as a method of conveyancing has now become obsolete.(Yogis, p. 25) 1, record 53, English, - bargain%20and%20sale

The cases make clear that whether or not parties are bound immediately by an informal oral agreement is a question of fact to be determined in each case. If the evidence indicates that the execution of a formal contract is a condition of the bargain, then the informal agreement is merely "a contract to make a contract, "and is not binding on the parties until the formal execution of an agreement. On the other hand, if the evidence indicates that the execution of a formal contract is merely the expression of the already complete and binding contract, then the informal agreement is binding and the formal documentation need not be completed. 2, record 56, English, - informal%20agreement

Plea bargaining.... Crown counsel and defence counsel negotiate out of court, and reach an agreement. Without purporting rigidly to limit the area on which agreements may be made, we say that usually such agreements are : 1. That Crown counsel will, if the accused pleads guilty to a lesser charge, withdraw a major charge.... 2. That Crown counsel, in return for a plea of guilty by the accused to a charge, will recommend to the Court the imposition of some lenient form of sentence, say probation. Or there may be a bargain which embraces both the above factors. 5, record 64, English, - plea%20bargaining

For reasons that will become evident in the course of this working paper,... we prefer to abandon the expression "plea bargaining"(which, to some, has an inherently negative connotation) in favour of more neutral terminology. In our view, the process with which we are concerned(though unquestionably flawed) may better be described as that of "plea negotiation", or the holding of "plea discussions". The object of that process is to reach a satisfactory agreement, not to give the accused a "bargain. "Accordingly, our recommendations eschew the expression "plea bargain" and replace it with "plea agreement". We define that expression(again, in neutral terms) as "any agreement by the accused to plead guilty in return for the prosecutor's agreeing to take or refrain from taking a particular course of action". 7, record 64, English, - plea%20bargaining

The object of that process is to reach a satisfactory agreement, not to give the accused a "bargain". Accordingly, our recommendations eschew the expression "plea bargain" and replace it with "plea agreement". We define that expression(again, in neutral terms) as "any agreement by the accused to plead guilty in return for the prosecutor's agreeing to take or refrain from taking a particular course of action". 1, record 84, English, - plea%20agreement

If the words rummage, swap, bargain, bric-a-brac or collectable excite you, then you might have an itch for a flea market. Nothing quite beats the thrill of coming home with a one-of-a-kind, rare or unusual souvenir retrieved from a bin and bought for a bargain. The allure of junk and valuable antiques thrown together and in need of sorting is aphrodisiac enough to some treasure hunters, but the added appeal of this happening only once a week, month or even a year makes some flea markets more coveted than others. 1, record 87, English, - flea%20market
