This phrase is a general denomination of personal property, as distinguished from real property. In the law of wills, the term "goods and chattels" will, unless restrained by the context, pass all the personal estate.(Black's, 5th ed., 1979, p. 624). 1, record 16, English, - goods%20and%20chattels

"Goods and chattels, "at the time when these words were introduced into English law, were used to embrace all property not included in "lands, tenements and hereditaments" which are technically descriptive of realty. As such, the expression "goods and chattels" is used as equivalent to "personalty, "but in the interpretation of dispositions and of statutes, this must not always be accepted.(Goodeve, 1937, pp. 8-9). 1, record 16, English, - goods%20and%20chattels

"Eviction," from "evincere," to evict or dispossess by course of law, was used originally when the person having the permanent title asserted it and expelled his tenant. But that sort of eviction is not absolutely necessary in order to operate as a suspension of the rent, and the word is now used when that has been done which deprives the tenant of the enjoyment of the premises, and the rent is therefore suspended, and the right of the landlord to recover it is gone. Nature of gratuitous loan for use. In deposit and mandate the bailor has all the advantages of the bailment. In gratuitous loan for use the reverse is the case. This is a bailment where a chattel is lent by its owner to the bailee for the express purpose of conferring a benefit upon the bailee, without any corresponding advantage to its owner. By English law this agreement is confined to goods, chattels or personal property, and does not, as under the Roman civil law, extend to real estate.(2 Hals., 4th, p. 849) 1, record 35, English, - gratuitous%20loan

Bargain and sale. Generally applies to land and refers to a contract for the sale of any estate or interest in real property or chattels followed by payment of the agreed purchase price. The phrase is also applied to transfer of personalty where there is an executory agreement of sale followed by a completed sale. Formerly, the Court of Chancery held that after a bargain and sale the vendor held the land to the use of, or for the benefit of, the purchaser. In 1536 the Statute of Uses executed the use in favour of the purchaser, thus giving him the same interest in the land as the vendor had. However, bargain and sale as a method of conveyancing has now become obsolete.(Yogis, p. 25) 1, record 46, English, - bargain%20and%20sale

To complete a distress a seizure of the chattels is necessary. A seizure may be either actual or constructive. It is actual by laying hands on the article, or on one of several articles, and claiming to detain it or them until the rent is satisfied. The most proper manner of making a distress is for the person distraining to go upon any part of the premises out of which the rent issues and take hold of some personal chattel declaring that it is taken as a distress in the name of all goods, or of so much as will satisfy the rent in arrear, and this will be a good seizure of all. It was so called because it was in the choice or election of the plaintiff whether he would sue out this writ or a fi. fa. ... the owner-driver was held liable to a child who fell through some defective floorboards and was run over, on the ground that the cause of the accident was not the negligent driving but the dangerous floorboards, for which the owner was responsible as the occupier of the automobile. Mr. Justice Aylesworth stated that "the statute does not provide an exemption from common law liability upon the owner of defective premises or in this case defective chattels, where injury arises from that defect known or which ought to be known to the owner of the chattel and when the person injured has been invited to enter into or on the chattel. 2, record 79, French, - lieux%20d%C3%A9fectueux
