El Código de Nuremberg (1946), plantea que no es suficiente la ciencia, ni siquiera la buena ciencia, para garantizar la rectitud moral de la investigación. La ciencia natural por sí sola es incapaz de resolver la cuestión ética. La experimentación que se ha llevado a cabo sobre seres humanos, está particularmente obligada a someterse a las normas universales del respeto al hombre. [...] Este código plantea en su primer punto que el consentimiento voluntario del sujeto humano es absolutamente esencial. Esto quiere decir que la persona debe tener capacidad legal para dar su consentimiento, debe estar informada de tal forma que le permita ejercer su libertad de escoger, sin la intervención de cualquier otro elemento de fuerza, fraude, engaño, coacción o algún otro factor posterior para obligar o coercer, y debe tener el suficiente conocimiento y comprensión de los elementos para permitirle tomar una decisión correcta.

[Canadian Medical Association] states that a physician has the right to refuse a patient, except on the basis of color, religion or political belief. However, the Code further provides that the right of refusal does not exist in an emergency and that a physician should render all assistance possible where an urgent need for medical care exists.

In 1994, the Presidents of the Medical Research Council of Canada(MRC), the Natural Sciences and Engineering Research Council of Canada(NSERC), and the Social Sciences and Humanities Research Council of Canada(SSHRC), collectively appointed a multi-disciplinary working group(the Tri-Council Working Group) and gave it the mandate to develop new policies and regulations to replace the Councils’ existing guidelines for research involving humans. The "Code of Ethical Conduct for Research Involving Humans"(the Code) is the result of that process and supersedes both the MRC "Guidelines on Research Involving Human Subjects" 1977 and the 1987 SSHRC "Ethics Guidelines for Research with Human Subjects". This Code complements the 1990 MRC "Guidelines for Research on Somatic Cell Gene Therapy in Humans".

Il remplace les «Lignes directrices concernant la recherche sur des sujets humains» du CRM publiées en 1987 et le «Code déontologique de la recherche utilisant des sujets humains» du CRSH, publié en 1977. Il complète les «Lignes directrices du CRM du Canada : Recherche sur la thérapie génique somatique chez les humains», publiées en 1990.
