The codicil which revives the earlier will may not revive a codicil to it. Where a testator made a will in 1866, made a codicil to it in 1871, made a later will in 1871 revoking all prior testamentary papers and in 1872, made a codicil which commenced by stating it was a codicil to the will of 1866 and concluded with the appointment of the testator's son as executor of the will and codicil and the attestation clause also described it as being a codicil to the will of 1866, it was held that the only intention to be gathered from the words of the codicil was that the testator intended to revive the will of 1866 but not the codicil of 1871.

Revocation of the whole or part of a will or codicil by another will or codicil, or by writing declaring an intention to revoke, or by destruction, requires an intention to revoke. The testator's intention to revoke may be absolute or conditional. If it is absolute, revocation takes place immediately. If it is conditional, revocation does not take place unless the condition is fulfilled. Often the condition makes revocation dependent upon the validity of another will or codicil and this particular type of conditional revocation has in the past been referred to as the doctrine of dependent relative revocation. The problem that usually confronts a Court of Probate to determine whether a revoked will is revived or not is often a difficult one of construction to be sure that the codicil shows the necessary "intention to revive". But when one only of two codicils was in dispute and an urgent need was shown for a grant to preserve the assets, probate of the will and first codicil was granted on the undertaking of the executors not to dispose of the property covered by the disputed codicil except to the extent necessary for the purpose of preserving it, as this course was obviously preferable to the appointment of an administrator pendente lite.
