Overholding with consent. Until rent is paid or something said or done on the part of the landlord to indicate an intention to treat the tenant holding over as his tenant for a further term, the landlord may treat him as a trespasser and bring an action of ejectment. When, however, a tenant is allowed to continue in possession after the expiration of a tenancy by agreement, the terms on which he continues to occupy are matters of evidence rather than of law. If there is nothing to show a different understanding he will be considered to hold on the terms of the old lease in so far as these terms are applicable. It is also a question of intention whether the parties, when the lease provides for overholding, intend the tenant to remain under the overholding provisions or under a new lease.(Anger and Honsberger, 2nd, p. 285-286)

If the evidence indicates that the execution of a formal contract is a condition of the bargain, then the informal agreement is merely "a contract to make a contract, "and is not binding on the parties until the formal execution of an agreement. On the other hand, if the evidence indicates that the execution of a formal contract is merely the expression of the already complete and binding contract, then the informal agreement is binding and the formal documentation need not be completed.

The Property Value Protection(PVP) Program was launched in 2001 as an integral part of the Legal Agreement that led to the creation of the Port Hope Area Initiative(PHAI). It provides assurance to property owners that if activities arising from the Port Hope or Port Granby projects affect the value of their home or land, compensation is available. The Program includes special services to assist owners of properties that show evidence of project effects and an independent appeals process for claimants who wish to appeal their PVP compensation award.
