Overholding with consent. Until rent is paid or something said or done on the part of the landlord to indicate an intention to treat the tenant holding over as his tenant for a further term, the landlord may treat him as a trespasser and bring an action of ejectment. When, however, a tenant is allowed to continue in possession after the expiration of a tenancy by agreement, the terms on which he continues to occupy are matters of evidence rather than of law. If there is nothing to show a different understanding he will be considered to hold on the terms of the old lease in so far as these terms are applicable. It is also a question of intention whether the parties, when the lease provides for overholding, intend the tenant to remain under the overholding provisions or under a new lease.(Anger and Honsberger, 2nd, p. 285-286) 1, record 10, English, - holding%20over

[T] here is the common law principle of conventional, consensual, or agreed boundaries. While in a sense all boundaries arise from acceptance or agreement or convention, the expression "conventional boundary" has a special meaning. The concept of a conventional boundary, as between adjoining property owners, rests on the prerequisite that another, the true boundary line of division, cannot be found, that it is uncertain and undeterminable, that it is lost, and not merely that it is unknown because sufficient enquiries have not been made or surveys performed... It would appear that there is no place for the admission of a conventional line where the true line is redeterminable on the evidence or the prescribed rules of the Act.("Survey Law in Canada", 1989, p. 150). 1, record 11, English, - conventional%20boundary

The cases make clear that whether or not parties are bound immediately by an informal oral agreement is a question of fact to be determined in each case. If the evidence indicates that the execution of a formal contract is a condition of the bargain, then the informal agreement is merely "a contract to make a contract, "and is not binding on the parties until the formal execution of an agreement. On the other hand, if the evidence indicates that the execution of a formal contract is merely the expression of the already complete and binding contract, then the informal agreement is binding and the formal documentation need not be completed. 2, record 13, English, - informal%20agreement

The auditor should plan and perform the audit to obtain reasonable, but not absolute, assurance that the client's claim is in compliance with the criteria established by provisions of the funding agreement taken in all material respects. Absolute assurance in auditing is not attainable because of such factors as : the nature of audit evidence which is based on the use of testing and where much of the evidence available to the auditor is persuasive, rather than conclusive; the inherent limitations of internal control; and the characteristics of fraud. 2, record 17, English, - persuasive
