Traditionally, trialists are people whose careers are built on conducting clinical trials that provide the evidence base needed for the high-quality practice of medicine. Because trialists have expertise in the condition to be studied by a trial, in the science of designing and conducting trials, or both, they are able to frame the research questions, study the key variables, perform state-of-the-art outcome measurements pertinent to the study question, and determine how best to gather that information. 3, record 1, English, - clinical%20trialist

At the bail hearing : the Crown prosecutor summarizes the nature of the offence, the evidence against the accused and the factors that will assist the Court in deciding if the accused should be held in custody or released until the trial. In some places, the police may represent the Crown prosecutor at bail hearings; and the Court must take into account any evidence about the need to ensure the victim or witness's safety. There was no justification for the resistance of counsel for the respondent to the admission of the evidence contained in the Humphrey affidavit. Its admission would mean only that the constitutional issue could be put to one side and the claim of the appellant determined on a proper factual basis as between her and the respondent. Refuge in the pleadings at trial and in the record at trial, as sought by counsel for the respondent, irrespective of the wrongful assertion as to title by the respondent on appeal to the Court of Appeal and, again, in his affidavit on taxation of costs after the appeal was determined in his favour, would mean insistence on a state of facts which were untrue... 1, record 20, English, - record%20at%20trial

The propounder of a will must prove by a preponderance of evidence that a testator was competent in every respect, and this includes negativing the existence of any insane delusions. On consideration of all the evidence and in the light of dealing with an otherwise thoroughly competent testator, the trial judge rejected the contention that a delusion existed. He found that the testator really believed the son to be legitimate, even though he expressed doubt. [1971] S. C. R., p. 847) 1, record 50, English, - competent%20testator

The concept of due process is rooted in English common law and expressed in "Magna Carta", Art. 39 (1215), whereby the King promised that ’No freeman shall be taken or imprisoned or disseised or exiled or in any way destroyed ... except by the legal judgment of his peers or by the law of the land’. This was later interpreted to require trial by jury. 4, record 79, English, - due%20process%20of%20law

"Due process" is an imprecise and elastic term, the meaning of which varies with time and place. Basically, it suggests fundamental fairness and tries to apply that concept to all parts of the criminal process. The breadth of the concept depends upon the subjective view of the American courts, particularly the United States Supreme Court. In the last twenty years "due process" has included protections against self-incrimination, coerced confessions, illegal searches, denial of counsel or jury trial and unregulated eavesdropping. In the American system a judicial finding that law enforcement officials have offended due process will result in a complete exclusion of the impugned evidence and will usually result in the acquittal of the accused. 5, record 79, English, - due%20process%20of%20law
