Although the witness would be unable to testify about the events, the writing itself may be admissible as evidence of its contents, if the witness can lay a foundation by establishing the criteria for "past recollection recorded". The four requirements are :(a) the witness must have had first hand knowledge of the event;(b) the written memorandum must be an original memorandum made at or near the time of the event while the witness had a clear and accurate memory of it;(c) the witness must lack a present recollection of the event; and(d) the witness must vouch for the accuracy of the written memorandum.

CONT

Clearly something used to revive a witness’s present recollection is not itself evidence of the event recalled but a mere catalyst; the evidence is the witness’s oral testimony based on his newly-revived memory. (Schiff, Evidence in the Litigation Process, p. 190)

Consent or the refusal of consent should be given by legally competent individuals or authorized third parties. This may be done in writing(preferred), orally, or clearly indicated by conduct. Evidence of consent or its refusal should be clearly documented and available for audit and legal purposes.

CONT

Consent can be oral or written. That said, however, written consent is usually preferable and is the norm in practice. It is preferable because it can be used as evidence should a dispute about consent arise in the future. It is important to note that the mere fact of a patient’s signature on a consent form does not constitute proof of consent. Instead, the content of the consent form can provide an evidentiary basis for conclusions about the content of the dialogue between the health care provider and the patient.

French

Domaine(s)
  • Droit de la santé
CONT
