The liability of occupiers hinges on the inveterate distinction... between activities creating risks of harm and the failure to take affirmative action to prevent harm.... the common law... was generally cool to the plea that anyone should be obliged to exert himself on behalf of another, at least in the absence of some corresponding benefit. This factor goes far to explain the erstwhile reluctance to expose occupiers to the discipline of a general duty of care....(However) the mere fact that the defendant happens to be an occupier does not mean his duties are necessarily and exclusively defined by his "occupancy" duties : they may well be augmented by a general duty of care as the result of some additional factor colouring his relationship to the plaintiff... 1, record 20, English, - general%20duty%20of%20care

Courts have used the word "consideration" with many different meanings. It is often used merely to express the legal conclusion that a promise is enforceable. Historically, its primary meaning may have been that the conditions were met under which an action of assumpsit(an early form of contract action) would lie. It was also used as the equivalent of the "quid pro quo" required in an action of debt. A seal, it has been said, imports a consideration, although the law was clear that no element of bargain was necessary to enforcement of a promise under seal. On the other hand, consideration has sometimes been used to refer to almost any reason asserted for enforcing a promise, even though the reason was insufficient(as in) promises in consideration of love and affection, illegal consideration, past consideration, and consideration furnished by reliance on a gratuitous promise where in fact there has been no consideration at all.(Yogis, 1983, p. 47). 2, record 27, English, - consideration

Under the present law if the accused takes the stand in his own defence he can be questioned about any previous convictions. Since such evidence si very prejudicial, many accused persons understandably choose not to take the stand. Under those circumstances, comment by the judge or prosecution about the accused's not taking the stand would be unfair. Generally, section 64(2) would permit the accused to take the stand without fear that his previous convictions would become known to the trier of fact. 1, record 33, English, - take%20the%20stand

An easement is an interest in land in the possession of another. It is not, itself, a possessory interest. Under the old law, a deed could not be delivered, as an escrow, direct to the grantee. Delivery in escrow was made to a third party-the first delivery-and, upon the fulfilment of the condition, the third party would deliver the deed to the grantee-the second delivery. It seems that the old law no longer applies. The more modern approach is to treat the question as one of fact; even where there is delivery to the grantee, the intention of the parties must be ascertained, from the transaction as a whole, as to whether the delivery was absolute or conditional.(Mendes da Costa and Balfour, p. 401) 1, record 69, English, - delivery%20in%20escrow

Under the common law rule, a class gift had to be able to vest within the perpetuity period in its entirety. If the interests of some members might vest outside the period, even though the interests of other members would vest in time, the gift was wholly void. The statutes, however, provide that in such a situation the class may be split, by excluding those persons whose interests do not in fact vest in time. As at common law, the class closing rules are permitted to operate first and they may save the gift. Under the statutes one then uses the wait and see principle and the age reduction provision. Subatomic particles have various properties and are affected by certain forces that exhibit symmetry. An important property that gives rise to a conservation law is parity. In quantum mechanics all elementary particles and atoms may be described in terms of a wave equation. If this wave equation remains identical after simultaneous reflection of all spatial coordinates of the particle through the origin of the coordinate system, then it is said to have even parity. If such simultaneous reflection results in a wave equation that differs from the original wave equation only in sign, then the particle is said to have odd parity. The overall parity of a collection of particles, such as a molecule, is found to be unchanged with time during physical processes and reactions; this fact is expressed as the law of conservation of parity. 2, record 82, English, - law%20of%20conservation%20of%20parity

The Terrorist and Disruptive Activities(Prevention) Act, commonly known as TADA, was an Indian law active between 1985 and 1995(modified in 1987) for the prevention of terrorist activities in Punjab. It was renewed in 1989, 1991 and 1993 before being allowed to lapse in 1995 due to increasing unpopularity due to widespread allegations of abuse. The drawback was that it didn’t provide a definition of the term "terrorist". The Act does not define the term "terrorist". It presumed that the accused was guilty. It had a conviction rate of less than 1% despite the fact that, under criminal law, a confession before a police officer, even though being given under torture, was admissible as evidence in court. A special court known as TADA court was set up to hear the cases and deliver judgements pertaining to 1993 Bombay bombings. 1, record 97, English, - Terrorist%20and%20Disruptive%20Activities%20%28Prevention%29%20Act
