Blue Sky Laws... The state of Kansas, most wonderfully prolific and rich in farming products, has a large proportion of agriculturists not versed in ordinary business methods. The State was the happy hunting ground of promoters of fraudulent enterprises; in fact their frauds became so barefaced that it was stated that they would sell building lots in the blue sky in fee simple. The word is used in law to denote the fact that a person dwells in a given place, or, in the case of a corporation, that its management is carried on there... In the case of a person, residence connotes the idea of home, or at least of habitation, and need not necessarily be permanent or exclusive. The word denotes the place where an individual eats, drinks, and sleeps, or where his family or his servants eat, drink and sleep...

CONT

... residence ... has in many instances been employed by Judges and others to denote a person’s habitual physical presence in a place or country which may or may not be his home. A person may have several residences in various countries; he can have ... but one domicil, which, in reality, may not be and indeed may never have been his home. The distinction between domicil and residence is largely one of mental condition or intention; domicil is generally a question of intent, while residence is entirely a question of fact.

It is the relation which the law creates between an individual and a particular locality or country. In order to constitute domicile, a person must not only have his permanent home in the locality but also the animus manendi, that is, the intention to make that residence his permanent one.

OBS

The term "domicil" is by no means synonymous with either "home" or "residence". Home is a natural and untechnical conception : domicil is an artificial conception, it is an idea of law... Courts have used the word "consideration" with many different meanings. It is often used merely to express the legal conclusion that a promise is enforceable. Historically, its primary meaning may have been that the conditions were met under which an action of assumpsit(an early form of contract action) would lie. It was also used as the equivalent of the "quid pro quo" required in an action of debt. A seal, it has been said, imports a consideration, although the law was clear that no element of bargain was necessary to enforcement of a promise under seal. On the other hand, consideration has sometimes been used to refer to almost any reason asserted for enforcing a promise, even though the reason was insufficient(as in) promises in consideration of love and affection, illegal consideration, past consideration, and consideration furnished by reliance on a gratuitous promise where in fact there has been no consideration at all.(Yogis, 1983, p. 47).

Delivery may be absolute or conditional and if the latter, it will be said to be delivery "in escrow" if the deed is to be held by someone not a party to it until some condition is performed by the party to be benefitted by the deed and upon fulfilment to take effect. (Lamont, "Real Estate Conveyancing", 1976, p. 85).

CONT

Under the old law, a deed could not be delivered, as an escrow, direct to the grantee. Delivery in escrow was made to a third party-the first delivery-and, upon the fulfilment of the condition, the third party would deliver the deed to the grantee-the second delivery. It seems that the old law no longer applies. The more modern approach is to treat the question as one of fact; even where there is delivery to the grantee, the intention of the parties must be ascertained, from the transaction as a whole, as to whether the delivery was absolute or conditional.(Mendes da Costa and Balfour, p. 401)

Under the common law rule, a class gift had to be able to vest within the perpetuity period in its entirety. If the interests of some members might vest outside the period, even though the interests of other members would vest in time, the gift was wholly void. The statutes, however, provide that in such a situation the class may be split, by excluding those persons whose interests do not in fact vest in time. As at common law, the class closing rules are permitted to operate first and they may save the gift. Under the statutes one then uses the wait and see principle and the age reduction provision. After that class splitting is permitted.(Anger & Honsberger, 2nd ed., 1985, p. 536).

The term "domestic animals" includes all those domestic or tame animals as by habit or training live in association with man. An animal which does not exist in a wild state anywhere in the world is in law a domestic animal. It is a question of law, not fact, whether an animal is within the class of domestic animals or wild animals.(2 Hals., 4th, p. 85-86)

OBS

The common law divided animals into two main groups, "domitae naturae", or domestic, and "ferae naturae", or wild. Domestic animals were treated the same as ordinary chattels and one might have an absolute property in them, but live, wild animals were subject only to a qualified or defeasible property right, dependent upon actual physical control or possession ... Subatomic particles have various properties and are affected by certain forces that exhibit symmetry. An important property that gives rise to a conservation law is parity. In quantum mechanics all elementary particles and atoms may be described in terms of a wave equation. If this wave equation remains identical after simultaneous reflection of all spatial coordinates of the particle through the origin of the coordinate system, then it is said to have even parity. If such simultaneous reflection results in a wave equation that differs from the original wave equation only in sign, then the particle is said to have odd parity. The overall parity of a collection of particles, such as a molecule, is found to be unchanged with time during physical processes and reactions; this fact is expressed as the law of conservation of parity.
