CONT

Courts have used the word "consideration" with many different meanings. It is often used merely to express the legal conclusion that a promise is enforceable. Historically, its primary meaning may have been that the conditions were met under which an action of assumpsit(an early form of contract action) would lie. It was also used as the equivalent of the "quid pro quo" required in an action of debt. A seal, it has been said, imports a consideration, although the law was clear that no element of bargain was necessary to enforcement of a promise under seal. On the other hand, consideration has sometimes been used to refer to almost any reason asserted for enforcing a promise, even though the reason was insufficient(as in) promises in consideration of love and affection, illegal consideration, past consideration, and consideration furnished by reliance on a gratuitous promise where in fact there has been no consideration at all.(Yogis, 1983, p. 47).

OBS

Technical sense, as in "doctrine of consideration."

DEF

A test for radial or ulnar patency : the patient elevates the hand and clenches the fist to express the blood from the hand. By finger pressure the radial and ulnar arteries are occluded. Then the hand is lowered, and the fist is opened. The arteries are released one at a time; the patency of each one is demonstrated by an immediate flush of blood into the pale skin of the palm. The radial, dorsalis pedis, and posterior tibial arteries may be similarly tested.

CONT

A retroactive statute is one that operates backwards, i. e., that is operative as of a time prior to its enactment, either by being deemed to have come into force at a time prior to its enactment(e. g., budgetary measures) or by being expressed to be operative with respect to past transactions as of a past time(e. g., acts of indemnity). A retroactive statute is easier to recognize because the retroactivity is usually express. A retrospective statute, on the other hand, changes the law only for the future but looks backward by attaching new consequences to completed transactions. it thus opens up closed transactions and changes their consequences as of the future.
