Rather than foster full recognition of both English and French in Canadian society, the actions of the Department of Justice would result in diminished opportunities for their use. The breach of obligations under section 41 must also be seen in light of the principle of official language equality under section 16 of the Charter, as well as the recognition that governments in Canada should advance by way of legislative action the equality of status or use of French and English. The principle of equality of our official languages must have substantive effects in order to ensure its full implementation. This imposes a constitutional obligation on the federal government to take the initiative in creating a necessary institutional support to the use of either official language. This obligation is ignored by action that reduces the scope of language rights as they apply to the legal process under federal jurisdiction. 1, record 20, English, - by%20way%20of%20legislative%20action

A new ecclesiastical jurisdiction has been eating away at the margins of civil authority. It surfaced as the dispute over "Political Correctness"(PC) or the seizure of normally secular jurisdiction by campus "courts". This new orthodoxy rests on the premise that colleges and universities have a jurisdiction over the lives of their students that is independent of the law of the land. The discussion of PC has indicated the ludicrous length this new faith has reached, and has done a good deal to discredit its prophets.(National Review, October 2, 1991, p. 34). 4, record 38, English, - political%20correctness

... State responsibility is governed by international standards..., and it depends on international law whether and to what extent the act or omission of a particular State is deemed legitimate or wrongful. Where the acts or omissions of a State measured by such standards are held to be legitimate, State responsibility does not arise. For example, as all States are generally conceded to have complete power to refuse to admit aliens into their territory, the States of which the aliens are nationals have no claim against any State which has refused ingress. Similarly, where international law concedes jurisdiction to a State which proceeds to exercise it, there is no breach of duty for which that State is responsible. 2, record 61, English, - legitimate

The French declaration mentions situations or facts. The(Permanent Court of Int. Justice) is of opinion that the use of these two terms shows the intention of the signatory State to embrace, in the most comprehensive expression possible, all the different factors capable of giving rise to a dispute. The Court also observes that the two terms «situations» and «facts» are placed in conjunction with one another, so that the limitation ratione temporis is common to them both, and that the employment of one term or of the other could not have the effect to extending the compulsory jurisdiction. 1, record 73, English, - facts%20and%20situations

Historically, in Nova Scotia, most environmental problems are the result of small, disparate projects which cumulatively have a significant impact on the environment. Recognizing that most of these problems are a consequence of inappropriate land use, the Department has recommended to the Deputy Minister's Land Use Committee and the Planning Act Review Committee, that municipalities should be given greater authority to regulate activities within their area of jurisdiction which could affect environmental resources. Submissions made by NSDOE and other departments to the Planning Act Review Committee have suggested the need for greater municipal control over the subdivision and development of land, aggregate resource zones, and surface water for drinking supplies. 1, record 78, English, - aggregate%20resource%20zone

1, record 78, French, - zone%20aux%20ressources%20multiples

The idea of the contiguous zone has not commended itself to all States. At the 1930 Hague Codification Conference nine States opposed it, including all the British Dominions and the United States. The United Kingdom pointed out that its revenue jurisdiction does not extend to foreign ships, but this is the case only since 1853. In The Le Louis in 1817, Lord Stowell said : Maritime states have claimed a right of visitation and enquiry within those parts of the ocean adjoining to their shores, which the common courtesy of nations has for their common convenience allowed to be considered as parts of their dominions for various domestic purposes... During the past several decades the coastal States of the world have been extending seaward their claims to jurisdiction over what has traditionally been recognized as the free seas. Claims have been both geographical, applied to specific maritime areas enclosed by boundaries, and functional, pertaining to certain competences such as control over fishing or drilling for hydrocarbons on the continental shelf. The net effect of these claims has been the gradual partitioning of nearly one-third of the global ocean into various types of maritime zones. The process of expanding maritime claims, sometimes termed "creeping jurisdiction" or "the ocean enclosure movement", may be approaching a temporary plateau. 1, record 84, English, - ocean%20enclosure%20movement

1, record 84, French, - mouvement%20exclusiviste
