HOLD COURT [18 records]

Record 1 2026-02-17

English

Subject field(s)
  • Aboriginal Law
DEF

[A] communal right of Aboriginal peoples to occupy and use the land inhabited by their ancestors from time immemorial.

CONT

In 1997, the Supreme Court of Canada ruled in the Delgamuukw case that Aboriginal title is a property right to the land itself-not just the right to hunt, fish and gather. [An] Aboriginal title is a communal right; an individual cannot hold [an] Aboriginal title.

OBS

Aboriginal title: A legal term that recognizes an Aboriginal interest in the land. It is based on the long-standing use and occupancy of the land by today’s Aboriginal peoples as the descendants of the original inhabitants of Canada.

Key term(s)
  • Aboriginal title to the land

French

Domaine(s)
  • Droit autochtone
CONT

English

Subject field(s)
  • Courts
  • Maritime Law
DEF

A court which may be summoned by the captain of H.M. ships on a foreign station, or by a consular officer ... Its jurisdiction is to hear a complaint by the master, mate, or any seaman, or to investigate if the interest of an owner or cargo-owner required it, or if a British ship is wrecked, abandoned or lost ... It is entirely different from a naval court-martial.

OBS

Any officer who commands a ship belonging to Her Majesty on any foreign station or any consular officer may hold such a court when a complaint which requires immediate investigation arises, when the owner's interest in any Canadian ship or cargo seems to require it or when a Canadian ship is abandoned, wrecked or lost.

CONT

An adverse inference generally is a legal inference, adverse to the concerned party, made from a party’s silence or the absence of requested evidence.

CONT

The term "adverse inference" means the court is permitted to draw a negative conclusion from the defendant's silence when interviewed at the police station; in other words, the court may hold the defendant's silence against him.

French

Domaine(s)
  • Droit de la preuve
CONT
