Record number: 2, Textual support number: 2 CONT
Necessity and proportionality have always been core principles of both branches of the jus belli principles that apply to both the authority to employ military force and the regulation of actual employment. However, in the jus ad bellum context, they have never before been viewed as principles to regulate operational and tactical execution. Instead, in that context they frame the legality of national or multinational resort to military force in self-defense. Once the decision is made to employ force pursuant to this authority, the jus in bello variant of these principles (necessity of the mission and proportionality of collateral damage) operate to regulate the application of combat power during mission execution (in other words, they provide the foundation for the regulation of the application of combat power in the context of the self-defense-justified mission). 4, record 2, English, - law%20of%20war

2, record 33, French, - reddition%20sans%20condition

The term "peace treaty" usually refers to a treaty between belligerents ending a war, through sometimes it refers to a treaty to prevent future wars. The two concepts are often combined, because in treaties ending wars, the parties have often pledged themselves to "perpetual peace". The terms of such treaties, however, are often so onerous that they stimulate the defeated state, which has signed under duress, to renew hostilities when the opportunity arises. 2, record 48, English, - peace%20treaty

In former times International Law empowered States when war was impending, or at its outbreak, to lay an embargo upon all enemy merchantmen in their harbours in order to confiscate them. Further, enemy merchantmen at sea could at the outbreak of war be captured and confiscated, although they did not even know of the outbreak of war. As regards enemy merchantmen in the harbours of the belligerents, it became, from 1854, during the Crimean War, a usage followed by some countries that no embargo should be laid on them for the purpose of confiscating them, and that a reasonable time, so-called days of grace, should be granted them to depart unmolested; but no rule was in existence until the Second Hague Conference of 1907, which produced a Convention(VI.) "relative to the Status of Enemy Merchant-ships at the Outbreak of hostilities». 3, record 52, English, - days%20of%20grace

In the legal sense, belligerency means war, or a situation of conflict by armed force in which all the participants are legally equal in respect to the hostilities. This implies that all belligerents are bound to observe the laws of war, are free to exercise war powers, and are entitled to expect from other states observance of the law of neutrality. 1, record 53, English, - belligerency

Although ready to terminate the war through a treaty of peace, belligerents are frequently not able to settle all the terms at once. In such cases hostilities are usually brought to an end through so-called preliminaries of peace, the definitive treaty to take the place of the preliminaries being concluded later on. Such preliminaries are a treaty in themselves, embodying an agreement between the parties regarding such terms of peace as are essential. Preliminaries are as binding as any other treaty, and therefore need ratification. Very often, but not necessarily, the definitive treaty of peace is concluded at a place other than that at which the preliminaries were settled. 1, record 80, English, - preliminaries%20of%20peace

... a preliminary treaty of peace may be either of two things. Sometimes it is only a promise to conclude a final treaty of peace, that is to say, a simple pactum de contrahendo. But sometimes also a preliminary treaty of peace contains clauses which manifestly restore peace, although the settlement of certain questions is altogether reserved for the final treaty. 2, record 80, English, - preliminaries%20of%20peace

Art. 1 of Convention(III) Relative to the Opening of Hostilities of the Hague Conference of 1907 provides that the hostilities between the contracting powers "must not commence without previous and explicit warning, in the form either of a reasoned declaration of war or of an ultimatum with conditional declaration of war". Moreover, under Art. 2, the existence of a state of war must be notified to neutral powers without delay, and would not take effect in regard to them until so notified, unless it were clearly shown that they were in fact aware of the existence of war. In the absence of such a declaration the legal effects of the war date from the commencement of hostilities if these are an expression of hostile intent. Although in that case the failure to make a declaration would constitute a breach of International Law. 1, record 81, English, - opening%20of%20hostilities

Three different kinds of hospital ships are dealt with in The Hague Convention. The first class relates to military hospital ships, i. e., ships constructed or adapted by a belligerent State specially and solely with a view to assisting the wounded, sick and shipwrecked, and the names of which are to be communicated to the other belligerent Powers at the commencement, or during the course, of hostilities, and in any case before they are employed. Such ships are to be respected and cannot be captured during the continuance of hostilities. 1, record 83, English, - military%20hospital%20ship

Armistices may be... general when all armed operations are suspended [or they may be] partial or local... One modern trend in regard to general armistices, however, is that they represent no mere temporary halting of hostilities, but a kind of de facto termination of war, which is confirmed by the final treaty of peace. In the case of a non-war armed conflict, as, for example, the Korean conflict, 1950-1953, the armistice puts an end to the conflict, and it may also be that a final peaceful settlement is contemplated by the contending parties. 1, record 85, English, - general%20armistice

... when war breaks out between certain powers, each nation wishing to remain impartial should normally issue either a special or general declaration of neutrality. Such a declaration, however, is by no means absolute. A neutral state may, during the course of the hostilities, repeal, change, or modify its position of neutrality, provided that such alterations are in accordance with international law and are applied without bias to all belligerents. The most important of the rights that result from a declaration of neutrality is the right of territorial integrity. Belligerents may not use a neutral' s territory as a base of operations or engage in hostilities therein. This right applies not only to neutral territory and water, but extends to air space above that territory as well. 1, record 86, English, - declaration%20of%20neutrality
