If a collective agreement cannot be achieved through negotiations, with or without the assistance of a mediator, voluntary interest arbitration can be considered. This option is available at any time during the collective bargaining negotiation process. This applies to any kind of bargaining, public or private sector, whether the right to strike/lockout exists, whether there are significant differences between the parties, and whether a dispute strike/lockout is imminent or underway. Both parties must agree to this process. Arbitration is binding. In International Law, equity may be considered a secondary source, and by Article 38(2) of the Statute of the International Court of Justice, referring to Article 38(1), «This provision shall not prejudice the power of the court to decide a case ex aequo et bono, if the parties agree thereto». The American Arbitration Association(AAA) is one of several arbitration organizations that administers arbitration of disputes brought to it by members of the public. The AAA also administers mediation and other forms of alternative dispute resolution. Many contracts include an arbitration clause naming the AAA as the organization that will administer an arbitration between the parties. The AAA does not itself arbitrate disputes, but provides administrative support to arbitrations before a single arbitrator or a panel of three arbitrators.
