Tax points came to prominence with the Federal-Provincial Fiscal Arrangements Act of 1961 ... when the federal and provincial governments converted from the tax rental arrangements (which originated during World War II) to separate federal and provincial personal and corporate income taxes (PIT and CIT). 3, record 1, English, - income%20tax%20point

[A tax point is] one percentage point of basic federal tax payable; this is the amount a province would get if the federal government transfers a personal income tax point to a province. If the federal government plans to transfer two tax points to the provinces to compensate them for taking over the full cost of what had been a shared-cost program, it turns over to each province two percentage points of the federal basic tax collected from the taxpayers of that province. In the case of corporate income tax, it is one percentage point of taxable corporate profits. 4, record 1, English, - income%20tax%20point

The set point theory [is] arguably the most influential and debated theory of body weight control. It suggests that like temperature in a room controlled by a thermostat, body weight(or body fat) is controlled by an equivalent device(ponderostat, adipostat) residing in the hypothalamus. Borrowing from the engineering vocabulary, this device receives feedback input from the controlled parameter(room temperature, body weight or body fat), and generates an error signal in a comparator if this feedback signal is deviating from a preset reference value(set point). The error signal is used to turn up or down any mechanisms that determine the level of the controlled parameter(heat production or dissipation in the case of room temperature, metabolizable energy-in or energy lost in the case of body weight/adiposity). 4, record 2, English, - ponderostat

L'hypothalamus joue un rôle central dans le contrôle, voire la régulation des réserves énergétiques. Record number: 16, Textual support number: 1 CONT
Elementary particles can be described in terms of a few simple properties. The most obvious of these are the mass and electric charge of the particle.... There is a... property which all particles carry, quantum mechanical spin. The name spin comes from an analogy with classical electro-magnetics. In classical electromagnetic theory, it is well known that a charged particle that is moving through a magnetic field will be deflected. If the particle... is spinning about some axis the deflection will be changed; i. e. the particle will go in a different direction than if it wasn’t spinning. The effect will depend on both the rate of spin and the rotation axis. In quantum mechanics, a similar effect is observed with any quantum particle. When passed through magnetic fields, they behave as if they are spinning electric charges. What's more, they behave as if their rates of spin are integral 0, 1, 2,... or half-integral(1/2, 3/2,...) of a base unit... much like charges come in basic multiples of the electron's charge. The concept of spin here is a bit more abstract than in the classical case. With a classical particle you can paint a little dot on the particle... and directly measure the rotation rate by counting the number of times you see the spot in a minute. This is not possible for quantum particles. They are not little spinning balls in that sense. 1, record 16, English, - quantum%20mechanical%20spin

A divorcing couple may decide to sign a post-dispute arbitration agreement if they can’t work out a property settlement or custody division in their divorce. Gyros that have stops(not many these days and not the case for the gyros in the CJ6) can be damaged by acro [acrobatics] when they are running. They should be stopped and preferably caged when doing acro. "Smooth" positive-G acro(no snap or tumbing maneuvers) shouldn’t hurt these gyros if they are powered down even if they are not caged.... When you subject that spinning gyro to your aircraft's twists and turns during aerobatics you are imparting more force on its bearings than you would were the gyro turned off and not spinning. It is usually bearing wear the trashes a gyro. This problem is especially severe when you are doing advanced aerobatics. It is really hard on the gyro bearings. I would rather have the gyros turned off to make them last longer. That we have caged or uncaged gyros is really irrelevant to the basic physics involved. 1, record 22, English, - uncaged

Another problem involving the use of words is the question of "conditional assault". If one person points a gun at another and says, "Your money or your life!", it might be argued that it is not assault because the plaintiff may avoid any harm by complying with the condition and parting with his money. It could be contended that the requirement of immediacy is absent. Such an argument is fallacious, however, for one cannot impose conditions upon another, when one has no legal right to do so. It would be otherwise of a landowner said to a trespasser, "Get off my land or I’ll throw you off, "for in such a case, the landowner is only threatening to do what he is entitled to do anyway. 1, record 30, English, - conditional%20assault

2, record 30, French, - voies%20de%20fait%20conditionnelles

This category of mistake is derived from a small group of cases most of them of modern times, although the doctrine existed at least as early as 1584. The general rule is that a man is estopped by his deed, and although there is no such estoppel in the case of ordinary signed documents, a party of full age and understanding is normally bound by his signature to a document, whether he reads or understands it or not. If, however, a party has been misled into executing a deed or signing a document essentially different from that which he intended to execute or sign, he can plead non est factum in an action against him. 1. The "dispersion of indications" can be expressed quantitatively by the standard deviation or by the range of dispersion(spread) of the indications. 2. The concept envisaged is equally applicable to measuring instruments and to graduated material measures. It is to be noted that insofar as material measures, which only reproduce a single value(or several separate values) of a quantity, are concerned, it is not theoretically correct to speak of dispersion of their "indications", given that these represent fixed values. In this case, however, it is the dispersion of the value reproduced of the quantity which is of interest, a dispersion that can be found by means of comparisons with a standard. 3. It is necessary to indicate the conditions under which the series of measurements in question is carried out :if these measurements are to follow directly one after the other; if between each of them there must be a certain time interval; if they must be carried out by the same observer or by different observers, etc... 1, record 51, English, - dispersion%20of%20indications

1, record 52, French, - Collections%20sans%20fronti%C3%A8res%20%3A%20P%C3%A9renniser%20les%20contenus%20num%C3%A9riques%20dans%20les%20%C3%A9tablissements%20culturels

Probate of a will in some jurisdictions requires the institution of a formal proceeding, upon notice to next of kin and others in interest, while in other jurisdictions probate is "pro forma" and notice, if any, is given after the will has been admitted to probate. The chief difference between the two kinds of probate is that in the former case(called "probate in solemn form" or "formal probate") persons who receive the required notice or appear in the proceeding must therein assert any objections they may have to the admission of the will to probate and, if they fail to do so, are, in general, precluded by the entry of a decree of probate from thereafter contesting the will or objecting to its validity; while in the latter case(called "probate in common form" or "informal probate") the will is first admitted to probate and any objections and contests may be asserted after probate.... In connection with an ordinary action, it should be borne in mind that a wrongful distress may be either illegal, excessive or irregular. If there was no right of distress at all, or if, although there was a right of distress, a wrongful act had been committed at the beginning of the levy(for example, in the time of entry or the seizure of privileged goods), the distress is illegal. If, although a right of distress exists, a wrongful act has been committed in the seizure of more goods than were reasonably necessary to satisfy the claim, the distress is excessive. And if, although a right of distress exists, a wrongful act has been committed at some stage of the proceedings subsequent to the seizure, the distress is irregular. Since the passing of the Judicature Acts, these distinctions are of much less importance than they used to be; for now, in every case of wrongful distress, the writ may be simple endorsed. In the case of a system with blade-angle adjustment, the electronic controller constantly measures the system's power output. Exactly why the words "and his heirs" where necessary to create an estate in fee simple is unclear.... was, however, necessary to use the plural word ’heirs" because if the grant were to a person and his "heir", that word could refer only to the person who would be the heir at the death of the grantee, so as not to be a word of inheritance or limitation. "Special property"... may mean that the subject-matter is incapable of being in the absolute ownership of any person. Thus a man may have a property in deer in a park, hares or rabbits in a warren, fish in a pond, etc. ;but it is only a special or qualified property, for if at any time they regain their natural liberty his property instantly ceases, unless they have "animus revertendi".(A) person may have a special property in a thing in the sense that he can only put it to a particular use. Thus, in the case of a bailment, the bailee has a special property in the thing bailed, for he is only entitled to deal with it in accordance with the... bailment....(Jowitt's, 2nd ed., 1977, p. 1447) 1, record 69, English, - special%20property

The essential difference between legal and equitable rights is best understood by comparing absolute ownership with trusts....(A) t this point it is only necessary to appreciate that trusts were unenforceable at common law. If land was conveyed to A in fee simple upon trust for B in fee simple, the common law courts regarded A as absolute owner and would not recognise any rights in B. But the Chancellor would enforce trusts, as matters of conscience, and compel A to hold the land on B's behalf and to allow B to enjoy it. In such a case A is the "legal owner", B is the "equitable owner". The land is vested in A, but since he is trustee of it he is not the beneficial owner : he has only the "bare legal estate", and the beneficial interest belongs to B. Now legal ownership confers rights "in rem", rights of property in the land itself, which can be enforced against anyone. Equitable ownership conferred at first only a right "in personam", a right to compel the trustee personally to perform his trust.(Megarry & Wade, 4th ed., 1975, p. 113). 1, record 70, English, - legal%20ownership

Remainders are either legal or equitable. If they are legal, they are subject to the legal remainder rules and to destruction.... They are subject, in addition, to the rule in "Shelley's Case" and the rule against perpetuities.... Legal remainders arise under common law conveyances, including modern grants. Formerly, they also arose under wills, but it is probable that all remainders arising under wills are now equitable.... The legal remainder rules are a carry-over from feudal land law and are based on the importance that the law attached to seisin. While they are long since out of tune with modern conditions, they remain in force in common law Canada.(Anger & Honsberger, 2nd ed., 1985, pp. 391-2). 1, record 71, English, - legal%20remainder

The doctrine of "escrow" is a relic of medieval times. It dates from the time when conveyances were made by feoffment and livery of seisin. It has survived to the present day and often operates in regard to conveyances of land or the creation or disposition of estates and interests in land such as a term of years.... It does predicate a document which is executed and delivered. The accustomed formula is "signed, sealed and delivered". When that formula is used in the document and it is signed by the party(or in the case of a company its seal is affixed) and attested by a witness with intent by the maker that it should be binding on him, it is conclusively presumed to be "signed, sealed and delivered". If it is handed over to another unconditionally, it is delivered as a deed. If it is handed over to another conditionally, it is delivered as an escrow. It only becomes a deed when the conditions are fulfilled....(Words and Phrases/England, v. 2, p. 173) 1, record 75, English, - doctrine%20of%20escrow

Aggregation of microscopic particles diffusing in a fluid medium represents a common process leading to fractal structures. If the density of the initially randomly distributed particles is larger than zero, the probability for two "sticky" particles to collide and stick together is finite. It is typical for such systems that the resulting two-particle aggregate can diffuse further and may form larger fractal clusters by joining other aggregates. In the above process each cluster is equivalent with regard to the conditions for their motion, i. e., there is no seed particle as in the case of DLA. Consequently, this process is called cluster-cluster aggregation(CCA) to distinguish it from particle-cluster aggregation(CCA) to distinguish it from particle-cluster aggregation phenomena. 1, record 87, English, - cluster%2Dcluster%20aggregation

Note that if were making a geologic map, we could draw a line on the map that separates the pelitic rocks containing only Pyrophyllite from those containing Kyanite + Quartz. Such a line(a surface in 3 dimensions) is called an isograd(iso-same, grad-grade). In this case, since it represents the first appearance of Kyanite, we call it the Kyanite Isograd... If we continue walking along the direction that T & P increased in these rocks during metamorphism, we would eventually come to another place where in the pelitic rocks the mineral assemblage changes. This time the change is from Kyanite + Quartz to Sillimanite + Quartz. Again, we can draw a line on the map that indicates this change in mineral assemblage, this time calling it the Sillimanite Isograd. Just like before, this represents the point on the phase diagram, above, where the geothermal gradient intersected the boundary for the reaction... Because the sandstone and the limestone do not contain Kyanite, the isograd does not appear in these rocks, but we can still extrapolate its position across the map or outcrop. 3, record 92, English, - sillimanite%20isograd

Fuel starvation and fuel exhaustion(sometimes referred to as fuel depletion) are problems that can affect internal combustion engines fuelled by either diesel, kerosene, petroleum or any other combustible liquid or gas. If no fuel is available for an engine to burn, it cannot function. All modes of transport powered by such engines can be affected by this problem, but the consequences are most significant when it occurs to aircraft in flight. There are two main ways that an engine can run out of fuel :-Using up fuel. This is the most common cause of fuel exhaustion. An engine can use up all available fuel due to insufficient fuel being loaded for the planned journey or the journey time extended for too long(in the case of an aircraft, due to in-flight delays or problems)... ;-Leaking. In some cases, the fuel tank or the supply piping to the engine leaks and fuel is lost. This can cause engines to starve. 1, record 96, English, - fuel%20exhaustion
