OBS

DEF

A release from imprisonment subject to supervision before the expiration of an offender’s sentence.

CONT

By law, most offenders who are serving determinate sentences, and who have not been granted parole or had their parole revoked, must be released on statutory release automatically after having served two-thirds of their sentence. Statutory release does not require a decision by the Parole Board of Canada... The Board may, however, impose special conditions.

OBS

The Corrections and Conditional Release Act abolishes earned remission and mandatory supervision, replacing them with statutory release which is automatically set at the two-thirds point of the sentence.

CONT

When acting within the boundaries of the statutory sentencing regime, of course, the sentencing judge must exercise his or her discretion within the parameters of the Criminal Code. The judge must impose sentences complying with statutory minimums and other provisions which prohibit certain forms of sentence in respect of the offence.

CONT

CONT

In practice, the determination of a term of imprisonment is necessarily intertwined with the decision of where the offender will serve the sentence. A judge does not impose a fixed sentence of “x months” in the abstract, without having in mind where that sentence will be served.

CONT
