Impossibilité en fait d'agir. [...] L'ancien droit français avait établi une règle selon laquelle la prescription ne courait jamais contre ceux qui se trouvaient dans l'impossibilité d'agir (contra non valentem agere non currit praescriptio). L'article 2904 [du Code civil du Québec] reprend ce principe en le limitant toutefois à une impossibilité factuelle et en prévoyant donc que la prescription ne court pas contre ceux qui sont «[...] dans l'impossibilité en fait d'agir» par eux-mêmes ou en se faisant représenter.

L'impossibilité en fait d'agir peut résulter entre autres d'une impossibilité psychologique d'agir ou de l'ignorance des faits générateurs de droit.
