La réquisition des logements ne doit pas être confondue avec la nationalisation ou la collectivisation des logements. La réquisition n'atteint pas le droit de propriété : elle ne porte que sur l'utilisation de la chose. La réquisition est une arme qu'on utilise en période de crise aiguë : elle permet de se procurer immédiatement ce qui existe, en passant sur des droits déjà établis. Il s'agit de transférer certaines personnes mal logées dans des logements habituellement inoccupés ou qui ne le sont que «partiellement».

Comme partout en France, les sans papiers et demandeurs d'asile lyonnais ont pour seule réponse de la part des autorités l'envoi des forces de l'ordre ! C'est pourquoi ils manifesteront avec le collectif de soutien. Pour faire face aux besoins les plus immédiats, un plan d'urgence a été établi en 1995 comportant la réalisation de 20 000 logements destinés aux plus démunis. En même temps un programme de réquisition de logements vacants détenus par des propriétaires institutionnels (administrations, banques, assurances) a été mis en œuvre, concernant d'abord 500 puis 700 logements dans l'agglomération parisienne.
