Record 1 2025-12-16

English

Subject field(s)
  • Penal Law
CONT

"Mental disorder automatism" arises only where involuntary action is found at law to result from a mental disorder and is subsumed by the defence of mental disorder. A successful claim of mental disorder automatism will trigger section 16 of the Criminal Code and result in a verdict of not-criminally responsible because of mental disorder.

French

Domaine(s)
  • Droit pénal
CONT

English

Subject field(s)
  • Offences and crimes
CONT

Non-mental-disorder automatism is defined as "[i]nvoluntary action which does not stem from a disease of the mind" ...; if successfully claimed, it results in the acquittal of the accused.

Key term(s)
  • non mental disorder automatism
  • non insane automatism

French

Domaine(s)
  • Infractions et crimes
CONT

The propounder of a will must prove by a preponderance of evidence that a testator was competent in every respect, and this includes negativing the existence of any insane delusions. On consideration of all the evidence and in the light of dealing with an otherwise thoroughly competent testator, the trial judge rejected the contention that a delusion existed. He found that the testator really believed the son to be legitimate, even though he expressed doubt. [1971] S. C. R., p. 847)

... slasher movies emphasize blood and gore, they tend to forsake plot and follow a simple formula. The standard slasher movie contains five basic elements : a killer, a terrible place, a weapon, victims, and a final girl. Killers are usually insane men who do not hold women in high regard. More than mere men, killers have the ability to survive attacks and be resurrected. The terrible place is often a house or other secluded/closed in area where the murders take place. Normally, the killer lives in a terrible place.
