In Canadian constitutional law, cooperative federalism is understood as both a descriptive concept and a legal principle.... As a legal principle, it serves as a guide for constitutional interpretation in division of powers cases. Cooperative federalism is to be "given due weight", meaning that sections 91 and 92 of the Constitution Act, 1867 should be read to allow for "interplay, indeed overlap" between spheres of federal and provincial authority and to favour "the application of valid rules adopted by governments at both levels" over enforcing strict jurisdictional silos. 2, record 1, English, - cooperative%20federalism

1, record 29, Spanish, - so%C3%B1ador

If it is a trial by judge alone, "apportionment of fault is primarily and properly a matter within the discretion of the trial judge... Constructive intention. Conduct may be treated as intentional even though its results are not actually desired, if the consequences are known to be substantially certain to follow.... In these circumstances it is sometimes said that the intention is "constructive", or that it has been "imputed" to the defendant. L'intention par interprétation. Un acte peut être considéré comme intentionnel s'il est virtuellement certain que les conséquences de l'acte se produiront, malgré qu'elles n'aient pas en fait été voulues. [...] Dans ces cas, on dit parfois que l'intention a été «imputée» au défendeur. En d'autres termes, ces actes sont considérés comme intentionnels même s'ils ne l'ont pas été en fait, parce que le droit n'accepte pas que l'on traite avec plus d'indulgence l'auteur de pareils actes. 2, record 42, French, - intention%20imput%C3%A9e

guarantee. A. And "warranty". Originally the same word, "warranty" and "guarantee"(or "-ty") arrived in the language through different medieval French dialects. "Guarantee" is the broader term, ordinarily meaning either(1) "the act of giving a security; the undertaking with respect to(a contract, performance of a legal act, etc.) that it shall be duly carried out, "or(2) "something given or existing as security, e. g., for fulfillment of an engagement or condition"(OED). "Warranty", as a legal term, has slightly more specific and elaborate senses :(1) "a covenant(either express or implied) annexed to a conveyance of realty by which the seller warrants the security of the title conveyed";(2) "an assurance, express or implied, given by the seller of goods, that he will be answerable for their possession of some quality attributed to them"(the seller hereby disclaims all warranties) ;or(3) "in a contract for insurance, an engagement by the insured that certain statements are true or that certain conditions shall be fulfilled"(OED). B. And "guaranty". The distinction in BrE once was that the former is the verb, the latter the noun. Yet "guarantee" is now commonly used as both n. & v. t. in both AmE and BrE. In practice, "guarantee", n., is the usual term, seen often, for example, in the context of consumer warranties or other assurances of quality or performance. "Guaranty", in contrast, is now used primarily in financial and banking contexts in the sense "a promise to answer for the debt of another. ""Guaranty" is now rarely seen in nonlegal writing, whether in G. B. or in the U. S. Some legal writers prefer "guaranty" in all nominal senses. 6, record 47, English, - warranty%20period

OCAD University is Canada’s "university of the imagination." Established in 1876 by the Ontario Society of Artists, the university was originally known as the Ontario School of Art, and was incorporated as the Ontario College of Art in 1912. OCAD was the first school in Canada dedicated exclusively to the education of professional artists in fine and commercial art. In 1996, it was renamed the Ontario College of Art & Design and in 2010, the name changed to OCAD University, reflecting the institution’s university status. 2, record 57, English, - Ontario%20College%20of%20Art%20%26%20Design%20University

Legal instrument first devised for the joint execution of the Polar Platform and POEM-1 Programmes. The text proposed is to be approved by the Participants like the Declarations, being related to two legally separate programmes, establishing a link between these two programmes. The aim of the act is twofold : firstly to ensure that the two declarations start simultaneously and secondly that their execution be managed in a unified manner. This legal instrument in a sense complements the provisions of both Declarations and of the implementing rules. "Estoppel may also be defined to be a legal result or "conclusion" arising from an admission which has either been actually made, or which the law presumes to have been made, and which is binding on all persons whom it affects. Or we may adopt the definition of estoppel given by Bramwell, L. J., as follows :"An estoppel may be said to exist where a person is compelled to admit that to be true which is not true, and to act upon a theory which is contrary to the truth. This formula nearly approaches a correct definition of estoppel. "(Everest & Strode's, 3rd ed., 1923, p. 1). 1, record 73, English, - estoppel

Any attempt to define "residential tenancy" is difficult. If one could define "tenancy", one would still be faced with the problem of defining "residential", which really involves an attempt to exclude "commercial" and "agricultural". We begin with "tenancy", which is simply a term descriptive of the interest in land acquired by a tenant from his landlord. In the more technical language of a common law property lawyer, the tenant's interest in land is a "non-freehold estate".... The next definitional problem is the term "residential". Fortunately, this term involves economic rather than legal concepts. We propose to define "residential premises" as a self-contained dwelling unit, and "residential tenancy" as a tenancy of residential premises for primarily residential purposes. Our proposed Act is not intended to apply to a tenancy for primarily commercial or agricultural purpose.(Alberta Law Reform Institute, Report on Residential Tenancies, 1977, pp. 10-11). 1, record 79, English, - residential%20tenancy

An expectancy or chance is a mere hope, unfounded in any limitation, provision, trust, or legal act whatever; such as the hope which an heir apparent has of succeeding to the ancestor's estate. This is sometimes said to be a bare or mere possibility, and, at other times, less than a possibility. It is a possibility in the popular sense of the term. But it is less than a possibility in the specific sense of the term possibility. For, it is no right at all, in contemplation of law, even by possibility; because, in the case of a mere expectancy, nothing has been done to create an obligation in any event; and where there is no obligation, there can be no right....(Fearne, 10th ed., 1844, pp. 23-24) 1, record 86, English, - expectancy
