1, record 10, Spanish, - Convenio%20sobre%20la%20Diversidad%20Biol%C3%B3gica

This article reexamines the rationales for and objections to universal jurisdiction, and argues that where public officials perpetrate serious international crimes, the arguments for upholding immunity are weak. In such cases, the arguments for universal criminal jurisdiction as a less invasive form of humanitarian intervention may be compelling. The article contends that the Security Council should withdraw immunity in such cases and that although this would be novel, there is both legal authority and historical precedent to support such action. 1, record 11, English, - withdraw%20immunity

The Peace Clause. Article 13("due restraint") of the Agriculture Agreement protects countries using subsidies which comply with the agreement from being challenged under other WTO [World Trade Organization] agreements. Without this "peace clause, "countries would have greater freedom to take action against each others’ subsidies, under the Subsidies and Countervailing Measures Agreement and related provisions. The peace clause is due to expire at the end of 2003. Some countries want it extended so that they can enjoy some degree of "legal security, "ensuring that they will not be challenged so long as they comply with their commitments on export subsidies and domestic support under the Agriculture Agreement. 2, record 18, English, - peace%20clause

2, record 18, French, - clause%20de%20paix

In distinguishing between the ordinary and natural meaning and the innuendo meaning of words, the substantive law cannot be separated from the requirements of pleading and the rules of evidence. If it is contented that words are defamatory in their ordinary and natural meaning, it is not necessary for the plaintiff to plead more than the words themselves.... If, however, the plaintiff wishes to rely on any special facts as giving the words a defamatory or any particular defamatory meaning, he must plead and prove such facts, including, where necessary, any special knowledge possessed by those to whom the words were published which gives the words that meaning, and must set out the meaning in his pleading.... the meaning resulting from those facts gives rise to a cause of action separate from that arising from the words in their ordinary and natural meaning. Courts have used the word "consideration" with many different meanings. It is often used merely to express the legal conclusion that a promise is enforceable. Historically, its primary meaning may have been that the conditions were met under which an action of assumpsit(an early form of contract action) would lie. It was also used as the equivalent of the "quid pro quo" required in an action of debt. A seal, it has been said, imports a consideration, although the law was clear that no element of bargain was necessary to enforcement of a promise under seal. On the other hand, consideration has sometimes been used to refer to almost any reason asserted for enforcing a promise, even though the reason was insufficient(as in) promises in consideration of love and affection, illegal consideration, past consideration, and consideration furnished by reliance on a gratuitous promise where in fact there has been no consideration at all.(Yogis, 1983, p. 47). 2, record 24, English, - consideration

The word tort comes from le Latin term torquere, which means "twisted or wrong. "The English common law recognized no separate legal action in tort. Instead, the British legal system afforded litigants two central avenues of redress : trespass for direct injuries, and actions "on the case" for indirect injuries. Gradually, the common law recognized other civil actions, including defamation, libel, and slander. 2, record 27, English, - action%20in%20tort

lis pendens(L. "a pending lawsuit") … is a useful LATINISM that has given its name to a notice required in some jurisdictions to warn all persons that certain property is the subject matter of litigation, and that any interests acquired during the pendency of the suit must be subject to the outcome of the litigation. Traditionally this notice was called the notice of lis pendens, but 20th century American lawyers have shortened the phrase to merely lis pendens. E. g., "The defendant says that the plaintiff's harsh conduct in holding up a whole subdivision by the lis pendens in this action disentitles him to relief. Rather than foster full recognition of both English and French in Canadian society, the actions of the Department of Justice would result in diminished opportunities for their use. The breach of obligations under section 41 must also be seen in light of the principle of official language equality under section 16 of the Charter, as well as the recognition that governments in Canada should advance by way of legislative action the equality of status or use of French and English. The principle of equality of our official languages must have substantive effects in order to ensure its full implementation. This imposes a constitutional obligation on the federal government to take the initiative in creating a necessary institutional support to the use of either official language. This obligation is ignored by action that reduces the scope of language rights as they apply to the legal process under federal jurisdiction. 1, record 37, English, - by%20way%20of%20legislative%20action

Data ownership is primarily a data governance process that details an organization's legal ownership of enterprise-wide data. A specific organization or the data owner has the ability to create, edit, modify, share and restrict access to the data. Data ownership also defines the data owner's ability to assign, share or surrender all of these privileges to a third party. This concept is generally implemented in medium to large enterprises with huge repositories of centralized or distributed data elements. The data owner claims the possession and copyrights to such data to ensure their control and ability to take legal action if their ownership is illegitimately breached by an internal or external entity. 2, record 38, English, - data%20ownership

One trained and licensed to prepare, manage, and either prosecute or defend a court action as an agent for another and who also gives advice on legal matters that may or may not require court action. Many of the terms listed above may be used interchangeably depending on the jurisdiction. These titles, and the rank and powers attributed to them, vary significantly from province to province and from state to state, thus necessitating a careful check of the pertinent jurisdiction's usage before choosing a term for a legal text. The following trends may be noted. "Lawyer" is a generic term. "Counsel", frequently used in Canada, may be a general term, or may refer more specifically to a lawyer who can plead in court. A "barrister" is a courtroom lawyer as opposed to a "solicitor" who is basically an office lawyer.(In Canada, both of these functions may be carried out by the same person). In some jurisdictions, "attorney" is used as a synonym of "lawyer", but in others, "attorney" becomes synonymous with "solicitor". Moreover, an "attorney-at-law" may sometimes plead in court. "Advocate" is the general word for a lawyer in Roman law jurisdictions(i. e. Quebec). 3, record 73, English, - lawyer

In a practical sense, sovereignty is also largely a matter of degree. Some States enjoy more power and independence than other States. This leads to the familiar distinction between independent or sovereign States, and non-independent or non-sovereign States or entities, for example, Protectorates and colonies. Even here it is difficult to draw the line, for although a State may have accepted important restrictions on its liberty of action, on other respects it may enjoy the widest possible freedom. "Sovereignty" is therefore a term of art rather than a legal expression capable of precise definition. 5, record 86, English, - sovereign%20state

2, record 86, French, - %C3%89tat%20souverain

A planned donation is a course of action, usually of a legal nature, that has the purpose of giving property or an asset to a recipient at a given moment in the future. Such transfers can be made during the benefactor's lifetime, but are most often executed after his death and can even be conditional on the prior death of a primary beneficiary, such as a spouse. For this reason, planned donations are often confused with bequests. 2, record 88, English, - planned%20gift

The terms "custom" and "usage" are often used interchangeably. Strictly speaking, there is a clear technical distinction between the two. Usage represents the twilight state of custom. Custom begins where usage ends. Usage is a international habit of action that has not yet received full legal attestation. Usages may be conflicting, custom must be unified and self-consistent. 3, record 98, English, - usage
