CONT

The language employed by the members of the court in this case is the language of estoppel. The judges all refer to the principal' s holding out the agent, of apparent authority to contract as he did, of making him an ostensible principal. It is suggested, however, that another way of looking at this case is by saying that once a man is put into a position of manager of a business which normally or usually carries with it the power to transact certain kinds of legal acts, then such a manager has authority to do whatever is so normal or usual.

One trained and licensed to prepare, manage, and either prosecute or defend a court action as an agent for another and who also gives advice on legal matters that may or may not require court action. Many of the terms listed above may be used interchangeably depending on the jurisdiction. These titles, and the rank and powers attributed to them, vary significantly from province to province and from state to state, thus necessitating a careful check of the pertinent jurisdiction's usage before choosing a term for a legal text. The following trends may be noted. "Lawyer" is a generic term. "Counsel", frequently used in Canada, may be a general term, or may refer more specifically to a lawyer who can plead in court. A "barrister" is a courtroom lawyer as opposed to a "solicitor" who is basically an office lawyer.(In Canada, both of these functions may be carried out by the same person). In some jurisdictions, "attorney" is used as a synonym of "lawyer", but in others, "attorney" becomes synonymous with "solicitor". Moreover, an "attorney-at-law" may sometimes plead in court. "Advocate" is the general word for a lawyer in Roman law jurisdictions(i. e. Quebec).

DEF

The creditor under a contract of guaranty, being the person to whom the principal debtor is primarily liable and to whom the guarantor is secondarily liable.

OBS

Both "guarantee" and "guarantor" have filled the role of agent noun for the verb "to guarantee". These words have shared the sense "one who makes a guaranty or gives a security, "but today "guarantor" has taken the field, rendering "guarantee" in this sense but a needless variant. Oddly, "guarantee" has been used not only as an equivalent of "guarantor", but also as a passive correlative of it consistently with other forms in-EE. Thus the OED quotes the following specimen of "guarantee"(=a person to whom a "guarantee" is given)/"Guarantors are believed by the "guarantee" being compelled, if one is ready to pay the whole, to sell him the debt of the others. "This use of "guarantee" may be useful in tandem with-or, but the actual occurrences of it in legal prose are rare.
