In Canadian constitutional law, cooperative federalism is understood as both a descriptive concept and a legal principle.... As a legal principle, it serves as a guide for constitutional interpretation in division of powers cases. Cooperative federalism is to be "given due weight", meaning that sections 91 and 92 of the Constitution Act, 1867 should be read to allow for "interplay, indeed overlap" between spheres of federal and provincial authority and to favour "the application of valid rules adopted by governments at both levels" over enforcing strict jurisdictional silos. 2, record 1, English, - cooperative%20federalism

2, record 1, French, - f%C3%A9d%C3%A9ralisme%20coop%C3%A9ratif

This article reexamines the rationales for and objections to universal jurisdiction, and argues that where public officials perpetrate serious international crimes, the arguments for upholding immunity are weak. In such cases, the arguments for universal criminal jurisdiction as a less invasive form of humanitarian intervention may be compelling. The article contends that the Security Council should withdraw immunity in such cases and that although this would be novel, there is both legal authority and historical precedent to support such action. 1, record 10, English, - withdraw%20immunity

The language employed by the members of the court in this case is the language of estoppel. The judges all refer to the principal' s holding out the agent, of apparent authority to contract as he did, of making him an ostensible principal. It is suggested, however, that another way of looking at this case is by saying that once a man is put into a position of manager of a business which normally or usually carries with it the power to transact certain kinds of legal acts, then such a manager has authority to do whatever is so normal or usual. 1, record 21, English, - ostensible%20principal
