In order to establish that a State has acquiesced to another State's claims, judges will take into account the consistent conduct of the State regarding the opposing claims. Isolated acts will not be deemed as sufficient to create a title of territorial sovereignty based on acquiescence. In addition, State conduct, such as a protest or the way in which a State continues to treat in its domestic legal system the territory in dispute, may defeat any claim based on acquiescence. 2, record 1, English, - claim

That contract involved, in my view, an obligation on the part of Devon Lumber to use its best effort to fill as expeditiously as possible those purchase orders received by it from East Coast. I am satisfied that until May 17 that obligation had been met. But there could be no legal justification for Mr. Gill' s on that day, merely because East Coast indicated that it would claim a charge-back, unilaterally renouncing his company's further then-standing obligations. His doing so amounted, in my opinion, to at least a technical breach of his agreement with East Coast.(Recueil des arrêts du Nouveau-Brunswick, Maritime Law Book, 90 R. Equity in the sense of fairness is frequently opposed to law and legality, because that which is fair does not always constitute a legal claim or defence. Hence, when a legal rule or remedy is capable of two interpretations or applications, one literal or restrictive, and the other liberal(that is, calculated to make the rule or remedy operate fairly, and to extend its benefit to as many cases as possible), the latter is called the equitable construction or application.(Jowitt's, 2nd ed. 1977, p. 712). 1, record 45, English, - equitable

Most writers maintain that States have as one of their fundamental rights the right of self-preservation, that is, a legal right to exist. They claim that the right of self-preservation is a primary, inherent, fundamental right, so fundamental that it takes precedence overall other rights. But there are authorities who deny the validity of this theory.... According to them this right means only that a State is entitled to protect itself and may attempt to maintain its independence. "The truth is, "says Brierly, "that self-preservation is not a legal right but an instinct... " 1, record 50, English, - right%20of%20self%2Dpreservation
