Another problem involving the use of words is the question of "conditional assault". If one person points a gun at another and says, "Your money or your life!", it might be argued that it is not assault because the plaintiff may avoid any harm by complying with the condition and parting with his money. It could be contended that the requirement of immediacy is absent. Such an argument is fallacious, however, for one cannot impose conditions upon another, when one has no legal right to do so. It would be otherwise of a landowner said to a trespasser, "Get off my land or I’ll throw you off, "for in such a case, the landowner is only threatening to do what he is entitled to do anyway. 1, record 4, English, - conditional%20assault

2, record 4, French, - voies%20de%20fait%20conditionnelles

guarantee. A. And "warranty". Originally the same word, "warranty" and "guarantee"(or "-ty") arrived in the language through different medieval French dialects. "Guarantee" is the broader term, ordinarily meaning either(1) "the act of giving a security; the undertaking with respect to(a contract, performance of a legal act, etc.) that it shall be duly carried out, "or(2) "something given or existing as security, e. g., for fulfillment of an engagement or condition"(OED). "Warranty", as a legal term, has slightly more specific and elaborate senses :(1) "a covenant(either express or implied) annexed to a conveyance of realty by which the seller warrants the security of the title conveyed";(2) "an assurance, express or implied, given by the seller of goods, that he will be answerable for their possession of some quality attributed to them"(the seller hereby disclaims all warranties) ;or(3) "in a contract for insurance, an engagement by the insured that certain statements are true or that certain conditions shall be fulfilled"(OED). B. And "guaranty". The distinction in BrE once was that the former is the verb, the latter the noun. Yet "guarantee" is now commonly used as both n. & v. t. in both AmE and BrE. In practice, "guarantee", n., is the usual term, seen often, for example, in the context of consumer warranties or other assurances of quality or performance. "Guaranty", in contrast, is now used primarily in financial and banking contexts in the sense "a promise to answer for the debt of another. ""Guaranty" is now rarely seen in nonlegal writing, whether in G. B. or in the U. S. Some legal writers prefer "guaranty" in all nominal senses. 6, record 5, English, - warranty%20period

The Court also distinguished between the legal right of redemption in foreclosure proceedings and a borrower's contractual right to reinstate a defaulted loan. By law, a defaulting borrower in foreclosure is entitled to redeem his or her property by paying the entire principal and interest due before confirmation of the sheriff's sale. When that happens, the lender has a legal duty to dismiss the foreclosure proceedings and may not condition that dismissal on payment of attorney fees. This differs from a contractual right to reinstate a loan. In that instance, the borrower typically pays only the amounts needed to make the loan current and continues all future payments on the previously agreed-upon schedule. 3, record 6, English, - legal%20right%20of%20redemption

... proviso generally has a narrower sense than provision(=a contractual term). In DRAFTING, a proviso is either a clause that is inserted in a legal or formal document and that makes some condition, stipulation, exception, or limitation, or a clause upon whose observance the operation or validity of the instrument depends. E. g., "When there is no accuracy or promptitude, the company should answer for all injury resulting, subject to the proviso that the injury must be the natural and direct consequence of the negligent act. At common law, a married woman's legal condition; "under the cover", influence and protection of her husband. In effect, the real property of which the woman was seised at the time of marriage, or afterwards, vested in both husband and wife during coverture, in right of the wife, and the husband was entitled to the profits therefrom and had sole control and management. As to personal property, at common law the husband became absolute owner of his wife's personal chattels. The disabilities of coverture in respect of property were eliminated by the English "Married Women's Property Act", 1882, and equivalent statutes in the Canadian provinces.(Yogis, 1983, p. 55). 1, record 14, English, - coverture

A ’do not resuscitate’(DNR) decision entails complex medical, legal and ethical issues. The effectiveness of cardiopulmonary resuscitation(CPR) varies according to the nature of the underlying clinical condition. Other issues which influence a DNR decision include the patients’ wishes, the nature of the underlying illness, the relatives’ wishes and expected future quality of life.... a ’do not resuscitate’ decision [is] considered appropriate if CPR is not expected to restart a patient's heart and breathing, if there are no benefits to be gained from restarting the patient's heart and breathing and if the expected benefits are outweighed by the burdens. 2, record 15, English, - do%20not%20resuscitate%20decision
