Courts have used the word "consideration" with many different meanings. It is often used merely to express the legal conclusion that a promise is enforceable. Historically, its primary meaning may have been that the conditions were met under which an action of assumpsit(an early form of contract action) would lie. It was also used as the equivalent of the "quid pro quo" required in an action of debt. A seal, it has been said, imports a consideration, although the law was clear that no element of bargain was necessary to enforcement of a promise under seal. On the other hand, consideration has sometimes been used to refer to almost any reason asserted for enforcing a promise, even though the reason was insufficient(as in) promises in consideration of love and affection, illegal consideration, past consideration, and consideration furnished by reliance on a gratuitous promise where in fact there has been no consideration at all.(Yogis, 1983, p. 47).

Doctrines of law are systematic formulations of legal principles, rules, conceptions, and standards with respect to particular situations, or types of cases, or fields of the legal order, in logically interdependent schemes, whereby reasoning may proceed on the basis of the scheme and its logical implications. Examples are the doctrine of consideration in contract, the doctrine of personal bar, and the doctrine of "respondeat superior". The development and formulation of doctrines are the work of judges and jurists, not of legislation, which treats of particular rules only.("Oxford Companion to Law", 1980, p. 371).

In English law, a promise is not, as a general rule, binding as a contract unless it is either made under seal or supported by some "consideration". The purpose of the doctrine of consideration is to put some legal limit on the enforceability of agreements even where they are intended to be legally binding and are not vitiated by some factor such as mistake, misrepresentation, duress or illegality.... The present position therefore is that English law limits the enforceability of agreements not under seal by reference to a complex and multifarious body of rules known as "the doctrine of consideration. After some hesitation it was settled in 1565 that if a tenant in fee simple covenanted to stand seized of his land in favour of some near relative, the "good consideration" of natural love and affection sufficed to raise a use in favour of the relative; the use was then executed and the legal estate vested in the relative. This type of conveyance was of limited application as it could not be employed to convey land to strangers, and, like the bargain and sale enrolled, it could not carry any further uses under the Statute.(Megarry and Wade, 4th ed., 1975, p. 165)
