LEGAL ESTOPPEL [7 records]

CONT

The language employed by the members of the court in this case is the language of estoppel. The judges all refer to the principal' s holding out the agent, of apparent authority to contract as he did, of making him an ostensible principal. It is suggested, however, that another way of looking at this case is by saying that once a man is put into a position of manager of a business which normally or usually carries with it the power to transact certain kinds of legal acts, then such a manager has authority to do whatever is so normal or usual.

... a disability whereby a party is precluded from alleging or proving in legal proceedings that a fact is otherwise than it has been made to appear by the matter giving rise to that disability. (Halsbury, 3rd ed., Vol. 15, p. 168).

OBS

"Estoppe, "says Lord Coke, "cometh of the French word "estoupe, "from whence the English word stopped; and it is called an estoppel or conclusion, because a man's own act or acceptance stoppeth or closeth up his mouth to allege or plead the truth. "Estoppel may also be defined to be a legal result or "conclusion" arising from an admission which has either been actually made, or which the law presumes to have been made, and which is binding on all persons whom it affects. Or we may adopt the definition of estoppel given by Bramwell, L. J., as follows :"An estoppel may be said to exist where a person is compelled to admit that to be true which is not true, and to act upon a theory which is contrary to the truth. This formula nearly approaches a correct definition of estoppel. "(Everest & Strode's, 3rd ed., 1923, p. 1).

In determining the issue as to the priority of the mortgages, the doctrine of "feeding the estoppel" was considered. This doctrine is invoked when a person has no legal interest in the land at the time of the conveyance. As soon as he acquires title, it "feeds the estoppel" so as to pass his title to the grantee, according to the covenants in the deed, but subject to any limitations or defects in his newly acquired title.(5 R. P. R., p. 16)

(Feed :) to lend additional support; to strengthen "ex post facto". A subsequently acquired interest is said to feed an estoppel. Thus, if A, not having the legal estate, but being estopped from denying that he has it, conveys property to B, then A's subsequent acquisition of the legal estate feeds the estoppel and the legal estate vests in B....(Jowitt's, 2nd ed., 1977, p. 780).
