This article reexamines the rationales for and objections to universal jurisdiction, and argues that where public officials perpetrate serious international crimes, the arguments for upholding immunity are weak. In such cases, the arguments for universal criminal jurisdiction as a less invasive form of humanitarian intervention may be compelling. The article contends that the Security Council should withdraw immunity in such cases and that although this would be novel, there is both legal authority and historical precedent to support such action.

Courts have used the word "consideration" with many different meanings. It is often used merely to express the legal conclusion that a promise is enforceable. Historically, its primary meaning may have been that the conditions were met under which an action of assumpsit(an early form of contract action) would lie. It was also used as the equivalent of the "quid pro quo" required in an action of debt. A seal, it has been said, imports a consideration, although the law was clear that no element of bargain was necessary to enforcement of a promise under seal. On the other hand, consideration has sometimes been used to refer to almost any reason asserted for enforcing a promise, even though the reason was insufficient(as in) promises in consideration of love and affection, illegal consideration, past consideration, and consideration furnished by reliance on a gratuitous promise where in fact there has been no consideration at all.(Yogis, 1983, p. 47).

The latter are sometimes called deed books, even though they include other types of documents, such as leases, mortgages and releases in addition to deeds.(Cunningham, Stoebuck and Whitman, 3rd ed., 1984, p. 797).

FAR (floor area ratio): the gross floor area of the building to the area of the lot on which it’s built. Each zoning district classification contains an FAR limit. A building can contain floor area equal to the lot area multiplied by the floor area ratio (FAR) of the district in which the lot is located. In a zone where the permitted FAR is a maximum of 1.0, a 40,000 sq foot lot (approximately an acre) could have 40,000 sq ft building. Staying within the Far limit, a developer might build a 4-story building at 10,000 sq ft per floor, or a 2-story building at 20,000 sq ft per floor. Height rules permitting, it could also be a 10-story building at 4,000 sq feet per floor. If the FAR is 4.0 (the greatest FAR currently permitted in Cambridge), the same lot could have a 160,000 sq ft building. Parking areas, cellar space, floor space in open balconies, elevator or stair-bulkheads, and other non-habitable space within the building do count as part of the FAR.

It is a much disputed question in the teaching of legal authorities and in the jurisprudence of the principal countries whether the doctrine of litispendance, the object of which is to prevent the possibility of conflicting judgments, can be invoked in international relations, in the sense that the judges of one State should, in the absence of a treaty, refuse to entertain any suit already pending before the courts of another State, exactly as they would be found to do if an action on the same subject had at some previous time been brought in due form before another court of their own country.

Art. 1 of Convention(III) Relative to the Opening of Hostilities of the Hague Conference of 1907 provides that the hostilities between the contracting powers "must not commence without previous and explicit warning, in the form either of a reasoned declaration of war or of an ultimatum with conditional declaration of war". Moreover, under Art. 2, the existence of a state of war must be notified to neutral powers without delay, and would not take effect in regard to them until so notified, unless it were clearly shown that they were in fact aware of the existence of war. In the absence of such a declaration the legal effects of the war date from the commencement of hostilities if these are an expression of hostile intent. Although in that case the failure to make a declaration would constitute a breach of International Law.
