The Court also distinguished between the legal right of redemption in foreclosure proceedings and a borrower's contractual right to reinstate a defaulted loan. By law, a defaulting borrower in foreclosure is entitled to redeem his or her property by paying the entire principal and interest due before confirmation of the sheriff's sale. When that happens, the lender has a legal duty to dismiss the foreclosure proceedings and may not condition that dismissal on payment of attorney fees. This differs from a contractual right to reinstate a loan. In that instance, the borrower typically pays only the amounts needed to make the loan current and continues all future payments on the previously agreed-upon schedule. 3, record 1, English, - legal%20right%20of%20redemption

At common law the creation of future interests was severely restricted.... Possible, but not assured; doubtful or uncertain; conditioned upon the occurrence of some future event which is itself uncertain, or questionable.... this term, when applied to a use, remainder, devise, bequest, or other legal right or interest, implies that no present interest exists, and that whether such interest or right ever will exist depends upon a future uncertain event.(Black's, 5th ed. 1979, p. 290) 1, record 3, English, - contingent

An interest may thus be said to be vested if, (a) it is limited to a person who is in existence, (b) it is limited to a person who is ascertained, and (c), it is limited to a person who is ascertained, and (c), it is not subject to a condition precedent. An interest is contingent or executory if it does not satisfy one of these three criteria, for in that case it is not presently capable of falling into possession upon the natural determination of all preceding interests.
