LEGAL LIFE [39 records]

Record 1 2026-04-21

English

Subject field(s)
  • Sentencing
CONT

Denunciatory sentences convey a message of social disapprobation, with the will of society expressed through the severity of the legal punishment. The seriousness of the crime is central to denunciation; there is little need to denounce shoplifting(although there may be a need to prevent such behaviour) but great necessity to denounce the intentional taking of human life(hence the mandatory sentence of life imprisonment for murder).

French

Domaine(s)
  • Peines
CONT

Most traditional actuarial disciplines fall into two main categories :life and non-life. Life actuaries, which include health and pension actuaries, primarily deal with mortality risk, morbidity risk, and investment risk. Products prominent in their work include life insurance, annuities, pensions, short and long term disability insurance, health insurance, health savings accounts, and long-term care insurance... Non-life actuaries, also known as property and casualty or general insurance actuaries, deal with both physical and legal risks that affect people or their property.

Another problem involving the use of words is the question of "conditional assault". If one person points a gun at another and says, "Your money or your life!", it might be argued that it is not assault because the plaintiff may avoid any harm by complying with the condition and parting with his money. It could be contended that the requirement of immediacy is absent. Such an argument is fallacious, however, for one cannot impose conditions upon another, when one has no legal right to do so. It would be otherwise of a landowner said to a trespasser, "Get off my land or I’ll throw you off, "for in such a case, the landowner is only threatening to do what he is entitled to do anyway.

French

Domaine(s)
  • Droit des délits (common law)
CONT

The word, heirs, is necessary in the grant or donation in order to make a fee, or inheritance. For if land be given to a man for ever, or to him and his assigns for ever, this vests in him but an estate for life.... [This rule] does not extend to devises by will; in which, as they were introduced at the time when the feodal rigor was apace wearing out, a more liberal construction is allowed : and therefore by a devise to a man for ever, or to one and his assigns for ever, or to one in fee-simple, the devisee hath an estate of inheritance; for the intention of the devisor is sufficiently plain from the words of perpetuity annexed, though be hath omitted the legal words of inheritance. But if the devise be to a man and his assigns, without annexing words of perpetuity, there the devisee shall take only an estate for life; for it does not appear the devisor intended any more....(Blackstone, Book II, p. 107-108)

[A]ny person having a tenancy.

The owner in fee is no less, in legal contemplation, a tenant, than the man who occupies under him, since the definition of tenant is one that holds or possesses lands, or tenements by any kind of title, either in fee, for life, years, or at will, and often includes a tenant at sufferance.(Cartwright, 1972, pp. 918-919).

OBS

In its proper use, "tenant" connotes either estate or tenure. Every person who has an estate in land is a tenant; thus, a person who has an estate in fee simple is a tenant in fee simple, and a person who has an interest in joint tenancy is a joint tenant. (Jowitt’s, 2nd ed. 1977, p. 1749).

The Japan Foundation was established in 1972 as a special legal entity under the auspices of the Ministry of Foreign Affairs for the purpose of promoting mutual understanding and friendship on the international scene. It was the first specialist organization for international cultural exchange in Japan, and it carries out a broad variety of cultural-exchange programs with personnel exchange as their basic premise, ranging from such academic pursuits as Japanese studies and Japanese-language education to the arts, publication, audio-visual media, sports, and general life culture. Its activities are financed by operation profits on government endowments, aid from the government(including the ODA budget), and funding and donations from the private sector.

The first table of the value of a life annuity of which we have any record, called the Ulpian Table(devised by a great Roman jurist, Ulpianus), arose out of the Falcidian Law. This law, enacted in B. C. 40, prevented a testator leaving more than three-quarters of his property to others than his legal heirs. It therefore became necessary to set a value on any legacies which were in the form of annuities payable for a fixed term or for life.
