Although the term "legal mortgage" is inappropriate to a mortgage under the land titles system and is not in fact in common use, the term "equitable mortgage", which under the old system is used in contradistinction to a legal mortgage, is under the new system commonly used to indicate a mortgage or charge other than a registered or statutory mortgage. Under the old system any mortgage subsequent to a legal mortgage is necessarily an equitable mortgage, but under the new system a second mortgage is of the same nature as a first mortgage. In other respects, however, the ordinary rules as to equitable mortgages prevail under the land titles system. Thus, an equitable mortgage may be created by an agreement to execute a mortgage or to charge money on land or by deposit of documents of title.(Falconbridge on Mortgages, 1977, 4th ed., s. 10. 11) 2, record 12, English, - registered%20mortgage

A may have the legal fee simple in Blackacre, subject to a legal mortgage in favour of B, a legal rentcharge in favour of C, a legal lease in favour of D, and so on. The legal fee simple is often referred to as the legal estate because of its paramount importance. Legal leases, mortgages, rentcharges, easements and the like are regarded as incumbrances upon it.(Megarry & Wade, 4th ed., 1975, pages 143-4). 1, record 14, English, - legal%20fee%20simple

Mortgage refinancing: refinancing a mortgage means paying off a current mortgage and replacing it with a new one. This can be done with the existing bank (lender) often named renewal or via another bank (lender). There are many unique reasons why homeowners refinance: to obtain a lower interest rate; to shorten the term of their mortgage; to change the type of mortgage; to access the home’s equity for other needs; mortgage refinancing when moving and buying a home; to consolidate debt; to be able to convert part or all of [the] mortgage interest to be tax-deductible in Canada. 2, record 18, English, - mortgage%20refinancing

2, record 18, French, - refinancement%20hypoth%C3%A9caire
