LEGAL PARLANCE [5 records]

Record 1 2024-04-03

English

Subject field(s)
  • Law of Evidence
  • General Vocabulary
DEF

A fact presumed to be true unless it is disproved.

CONT

In common parlance the term "prima facie" is used to describe the apparent nature of something upon initial observation. In legal practice the term generally is used to describe two things : the presentation of sufficient evidence by a civil claimant to support the legal claim(a prima facie case), or a piece of evidence itself(prima facie evidence).

French

CONT

English

Subject field(s)
  • PAJLO
  • Property Law (common law)
DEF

To acquire real property other than by descent. Thus, in very technical legal parlance, gifts are purchased by those who receive them.(Garner, p. 453)

OBS

"Acquire by purchase" is used in its technical sense in this context.

French

Domaine(s)
  • PAJLO

  • Plant and Crop Production
DEF

Literally, a crop in the process of growth, an unmatured crop. But a disputed term in legal parlance. Some authorities hold that a growing crop may be either above or below the surface of the soil, while other authorities hold that a crop is not a growing crop unless it shows above ground, and that underground sprouts do not constitute such a crop. Again, some authorities hold that a crop is growing from the time the seed is planted until the harvest, while other authorities hold that a matured, ungathered crop is not growing. Whether grass in a pasture is a growing crop is also a controverted question.(Ballentine's, 3rd ed., 1969, p. 538)

CONT

The meaning of "transmission" as used in legal parlance in relation to the change of ownership of shares is very limited. Therefore "transmission" in French should in some contexts be translated as "transfer"...

French

Domaine(s)
  • Gestion de l'entreprise (Généralités)
  • Organismes commerciaux ou non (Droit)
DEF
