The concept of due process is rooted in English common law and expressed in "Magna Carta", Art. 39 (1215), whereby the King promised that ’No freeman shall be taken or imprisoned or disseised or exiled or in any way destroyed ... except by the legal judgment of his peers or by the law of the land’. This was later interpreted to require trial by jury. 4, record 1, English, - due%20process%20of%20law

"Due process" is an imprecise and elastic term, the meaning of which varies with time and place. Basically, it suggests fundamental fairness and tries to apply that concept to all parts of the criminal process. The breadth of the concept depends upon the subjective view of the American courts, particularly the United States Supreme Court. In the last twenty years "due process" has included protections against self-incrimination, coerced confessions, illegal searches, denial of counsel or jury trial and unregulated eavesdropping. In the American system a judicial finding that law enforcement officials have offended due process will result in a complete exclusion of the impugned evidence and will usually result in the acquittal of the accused. 5, record 1, English, - due%20process%20of%20law

A game tree is a representation of the possibilities of two players in a game, like chess. At the top of the tree is the current game position, and each arc out represents a legal move for the first player. The language employed by the members of the court in this case is the language of estoppel. The judges all refer to the principal' s holding out the agent, of apparent authority to contract as he did, of making him an ostensible principal. It is suggested, however, that another way of looking at this case is by saying that once a man is put into a position of manager of a business which normally or usually carries with it the power to transact certain kinds of legal acts, then such a manager has authority to do whatever is so normal or usual. 1, record 6, English, - ostensible%20principal

It is essential to an understanding of legal surveying to appreciate that, at common law, the first creation of a boundary or the demarcation of the extent of rights or ownership in land is absolute and will remain in its original unaltered position for all time. This statement is, however, beguilingly simple. Having said that an original boundary is unalterable, we must also appreciate that the retracement of an original boundary is an exercise in the assessment of evidence.("Law Society of Upper Canada, Real Estate and Landlord and Tenant", 1986-87, p. 95). 1, record 13, English, - original%20boundary

The position reached by the common law was that estates of freehold represented real property law in the strict sense of that term, and as such were subject to all the consequences of feudal tenure; while on the other hand leaseholds(together with some other rights in land) were not so subject, and for this reason were neither affected by the incidents of feudalism, nor governed by the same legal rules as freeholds.(Cheshire's, 12th ed., p. 39). 1, record 15, English, - feudal%20tenure

In English law, a promise is not, as a general rule, binding as a contract unless it is either made under seal or supported by some "consideration". The purpose of the doctrine of consideration is to put some legal limit on the enforceability of agreements even where they are intended to be legally binding and are not vitiated by some factor such as mistake, misrepresentation, duress or illegality.... The present position therefore is that English law limits the enforceability of agreements not under seal by reference to a complex and multifarious body of rules known as "the doctrine of consideration. There is one class of goods, it seems, in respect of which there may be a sale even though they are not existing at the time of the contract. The legal property in such goods can pass to the buyer without any need to conform to the provisions of the Act relating to the transfer of property. Such goods are those which have "potential existence". The distinction existed at common law between future goods to be manufactured or acquired by the seller, the position with respect to which has been considered above, and future goods in which the seller had what was called "a potential property". Such goods comprehended things which were the natural produce or expected increase of something already owned or possessed by the seller, for example, hay to be grown in a field, wool to be grown on sheep owned by the seller, or milk to be yielded by the seller's cows in the coming month. 1, record 28, English, - potential%20property

While terms such as "employee" and "person employed" have legal meanings, the distinction between them may not be understood by prospective candidates. For this reason, when it is intended to restrict the area of selection to "employees" of a particular Public Service organization, it may be preferable to specify that eligibility is limited to persons whose substantive position is within that organization(as a result of a deployment or appointment). 2, record 29, English, - person%20employed%20in%20the%20Public%20Service
