Cooperative federalism is predicated largely on a web of more or less informal, ongoing intergovernmental relationships and institutional arrangements that seek to adapt the formal structure of the Constitution to the economic and social needs and fiscal realities of a modern federal state. Taken in that light, it is perhaps less a principle than a practice, and more political than legal in its nature and substance... 1, record 1, English, - cooperative%20federalism

Research that takes the gender dimension into account is found in most scientific disciplines. For instance, a legal research project may investigate how gender-neutral legal rules affect women and men differently. An example of this is the effect of retirement pension rules. In many countries the rules are universal and gender neutral, and pensions are based on previous income. In practice, however, this theoretically gender‑neutral rule may have different outcomes for women and men. Women who have worked part-time or stayed at home to take care of children receive much lower pensions than men(and women) who have worked full-time. In legal research, the gender dimension involves exploring how gender relations influence the distribution of rights and duties, benefits and disadvantages, legal protection and punishment. 2, record 5, English, - gender%20dimension

guarantee. A. And "warranty". Originally the same word, "warranty" and "guarantee"(or "-ty") arrived in the language through different medieval French dialects. "Guarantee" is the broader term, ordinarily meaning either(1) "the act of giving a security; the undertaking with respect to(a contract, performance of a legal act, etc.) that it shall be duly carried out, "or(2) "something given or existing as security, e. g., for fulfillment of an engagement or condition"(OED). "Warranty", as a legal term, has slightly more specific and elaborate senses :(1) "a covenant(either express or implied) annexed to a conveyance of realty by which the seller warrants the security of the title conveyed";(2) "an assurance, express or implied, given by the seller of goods, that he will be answerable for their possession of some quality attributed to them"(the seller hereby disclaims all warranties) ;or(3) "in a contract for insurance, an engagement by the insured that certain statements are true or that certain conditions shall be fulfilled"(OED). B. And "guaranty". The distinction in BrE once was that the former is the verb, the latter the noun. Yet "guarantee" is now commonly used as both n. & v. t. in both AmE and BrE. In practice, "guarantee", n., is the usual term, seen often, for example, in the context of consumer warranties or other assurances of quality or performance. "Guaranty", in contrast, is now used primarily in financial and banking contexts in the sense "a promise to answer for the debt of another. ""Guaranty" is now rarely seen in nonlegal writing, whether in G. B. or in the U. S. Some legal writers prefer "guaranty" in all nominal senses. 6, record 20, English, - warranty%20period

En revanche, les autres techniciens sont des détenteurs d'un diplôme collégial, travaillant dans un cabinet ou une agence gouvernementale comme auxiliaires d'un avocat ou d'un notaire. 9, record 24, French, - technicien%20juridique

The legislation relating to registration of title is directed to the manner in which the law and practice of conveyancing are to be adapted to the use of a centrally maintained register of title to land. As the use of the register has been extended, so the successive statutes mark the historical development of a system of conveyancing, commonly known as registered conveyancing, which approached maturity as part of the real property legislation of 1925. The result of that legislation, as respects registered land, is to produce on first registration a state insured, but nevertheless private, record of entitlement to legal estates in land, such record to be kept up to date in respect of subsequent transactions in accordance with the conveyancing technique for which the legislation provides.(26 Halsbury, 4th ed., p. 404). 1, record 27, English, - registered%20conveyancing

The term "domestic jurisdiction", as used in the theory and practice of international law, mainly since the Covenant of the League of Nations, is not a new legal concept from the point of view of its content. Indeed, it does not mean anything else or anything more than the term sovereignty in the sense of the supreme power of the State over its territory and inhabitants in the framework of international law binding upon the State. What some authors used to call "internal sovereignty" corresponds to domestic jurisdiction. The term "peaceful uses of outer space" appears in official government statements and multilateral treaties. However, the examination of the state practice leads to the conclusion that this term is still without an authoritative definition. It is a source of considerable confusion and creates a legal grey area. The widely accepted interpretation of this key term of space law prior to the begin of space age, namely that "peaceful" means "non-military, "was soon contradicted by the practice of two space powers. In the period between 1957 and the adoption of the Outer Space Treaty in 1967, these two powers had placed into orbit a number of military payloads and had come increasingly dependent on space technology in their military planning. Since the term "peaceful" continues to be used, it is useful to examine the meaning of this ambiguous adjective. 2, record 33, English, - peaceful%20use%20of%20outer%20space

Associations of states. Independent states may enter into forms of co-operation by consent and on an equal basis. The basis for the co-operation may be the constitution of an international organization, such as the United Nations or the World Health Organization. However, by treaty or custom other structures for maintaining co-operation may be created. One such structure, the confederation, has in practice either disintegrated or been transformed into a federation. In recent times the British Commonwealth of Nations and the French Community have provided examples of associations of states of a special type. Membership of these two associations would not necessarily affect the primary legal capacities and personality of member states any more than membership of an organization and has less effect than membership of some organizations, for example, the European Economic Community, which has a slight federal element, albeit on a treaty basis. 3, record 35, English, - association%20of%20states

The doctrine [of equality of States] imports not merely equality at law, but also the capacity for equal legal rights and equal legal duties. The results of the doctrine are seen particularly in the law and practice as to multilateral treaties where generally the rule has prevailed that unanimity is necessary for the adoption of these instruments by States in Conference. [...] To quote one authority «The unanimity rule, conceived as the safeguard of the minority, has, through exaggerating the doctrine of equality, become and instrument of tyranny against the majority». 1, record 50, English, - unanimity%20rule
