In Canadian constitutional law, cooperative federalism is understood as both a descriptive concept and a legal principle.... As a legal principle, it serves as a guide for constitutional interpretation in division of powers cases. Cooperative federalism is to be "given due weight", meaning that sections 91 and 92 of the Constitution Act, 1867 should be read to allow for "interplay, indeed overlap" between spheres of federal and provincial authority and to favour "the application of valid rules adopted by governments at both levels" over enforcing strict jurisdictional silos. 2, record 1, English, - cooperative%20federalism

Cooperative federalism is predicated largely on a web of more or less informal, ongoing intergovernmental relationships and institutional arrangements that seek to adapt the formal structure of the Constitution to the economic and social needs and fiscal realities of a modern federal state. Taken in that light, it is perhaps less a principle than a practice, and more political than legal in its nature and substance... 1, record 2, English, - cooperative%20federalism

Most business people understand that a company is a separate legal "person" from its members and, by its creation, limits the personal liability of any individual officer, director or shareholder for its behavior. This legal principle has been around since the 1800s, established in the now famous English House of Lords case, Salomon v Salomon. It is not always applied by the courts, however, and there are certain circumstances where the courts will "look behind" or "lift the corporate veil" to find individuals responsible for bad company acts. 4, record 8, English, - lift%20the%20corporate%20veil

Rather than foster full recognition of both English and French in Canadian society, the actions of the Department of Justice would result in diminished opportunities for their use. The breach of obligations under section 41 must also be seen in light of the principle of official language equality under section 16 of the Charter, as well as the recognition that governments in Canada should advance by way of legislative action the equality of status or use of French and English. The principle of equality of our official languages must have substantive effects in order to ensure its full implementation. This imposes a constitutional obligation on the federal government to take the initiative in creating a necessary institutional support to the use of either official language. This obligation is ignored by action that reduces the scope of language rights as they apply to the legal process under federal jurisdiction. 1, record 14, English, - by%20way%20of%20legislative%20action

Once all these matters have been agreed to the satisfaction of the parties, they are said to have reached agreement "subject to contract". The agreement will not be binding until there has been a formal exchange of contracts. This means that, although the parties have agreed in principle and may have spent significant sums of money on legal fees, search fees, fees to the lender, either party may withdraw from the transaction. 2, record 28, English, - subject%20to%20contract

The equality of states is a general principle of international law. It is a necessary corollary of the concepts of sovereignty and independence of states. However, it is only the legal equality, or equality before the law, which is in question. States are of course not equal in fact. The general consequence is that each state is entitled to equal treatment under the law. 1, record 33, English, - equality%20of%20states

Surely a government such as that of General Franco which considers itself to be the legal government of Spain cannot, as it seems to me, sit passively by while the proceedings are in process and would have the duty towards itself to contest the legitimation of its rival as party to the proceedings or, rather, on grounds of deeper principle, to attack the validity of the special agreement itself as having been concluded by an "illegal government". 1, record 37, English, - legal%20government

It is sometimes asserted that a state may exist even though it has no territory, and in this connection instances of the governments in exile during the World War II are cited. This, however, is not a true illustration because the cases of the governments in exile are merely examples of lawful governments functioning from another country during continuance of military operations. The dispossession of the lawful government by the invader pendente bello is no more than an incident of military operations. 2, record 37, English, - legal%20government
