The concept of due process is rooted in English common law and expressed in "Magna Carta", Art. 39 (1215), whereby the King promised that ’No freeman shall be taken or imprisoned or disseised or exiled or in any way destroyed ... except by the legal judgment of his peers or by the law of the land’. This was later interpreted to require trial by jury. 4, record 1, English, - due%20process%20of%20law
Record number: 1, Textual support number: 2 CONT
"Due process" is an imprecise and elastic term, the meaning of which varies with time and place. Basically, it suggests fundamental fairness and tries to apply that concept to all parts of the criminal process. The breadth of the concept depends upon the subjective view of the American courts, particularly the United States Supreme Court. In the last twenty years "due process" has included protections against self-incrimination, coerced confessions, illegal searches, denial of counsel or jury trial and unregulated eavesdropping. In the American system a judicial finding that law enforcement officials have offended due process will result in a complete exclusion of the impugned evidence and will usually result in the acquittal of the accused. 5, record 1, English, - due%20process%20of%20law

The Court also distinguished between the legal right of redemption in foreclosure proceedings and a borrower's contractual right to reinstate a defaulted loan. By law, a defaulting borrower in foreclosure is entitled to redeem his or her property by paying the entire principal and interest due before confirmation of the sheriff's sale. When that happens, the lender has a legal duty to dismiss the foreclosure proceedings and may not condition that dismissal on payment of attorney fees. This differs from a contractual right to reinstate a loan. In that instance, the borrower typically pays only the amounts needed to make the loan current and continues all future payments on the previously agreed-upon schedule. 3, record 14, English, - legal%20right%20of%20redemption

1, record 16, French, - substitut%20du%20procureur%20g%C3%A9n%C3%A9ral

"Estoppe," says Lord Coke, "cometh of the French word "estoupe," from whence the English word stopped; and it is called an estoppel or conclusion, because a man’s own act or acceptance stoppeth or closeth up his mouth to allege or plead the truth." Estoppel may also be defined to be a legal result or "conclusion" arising from an admission which has either been actually made, or which the law presumes to have been made, and which is binding on all persons whom it affects. Or we may adopt the definition of estoppel given by Bramwell, L.J., as follows: "An estoppel may be said to exist where a person is compelled to admit that to be true which is not true, and to act upon a theory which is contrary to the truth. This formula nearly approaches a correct definition of estoppel." (Everest & Strode’s, 3rd ed., 1923, p. 1). 1, record 18, English, - estoppel

Ottawa, Canadian Heritage. Compiled by international heritage law experts, Dr. Patrick J. O’Keefe and Professor Lyndel V. Prott, the Heritage Law Bibliography is a source of a great deal of bibliographic information pertaining to legal issues surrounding cultural and natural heritage in about 100 countries. Citations are drawn from the international literature and include books, journal articles, conference proceedings, reports of litigation, and government documents. This database grew out of research by Dr. O’Keefe and Professor Prott for their five-volume series, Law and the Cultural Heritage. Topics include the theft of artifacts, repatriation, and the unlawful trade in cultural goods. This database is a current and exhaustive guide to literature on the heritage laws in various jurisdictions. Data remain in the languages in which they were recorded. 1, record 24, English, - Heritage%20Law%20Bibliography

Surely a government such as that of General Franco which considers itself to be the legal government of Spain cannot, as it seems to me, sit passively by while the proceedings are in process and would have the duty towards itself to contest the legitimation of its rival as party to the proceedings or, rather, on grounds of deeper principle, to attack the validity of the special agreement itself as having been concluded by an "illegal government". 1, record 81, English, - legal%20government

It is sometimes asserted that a state may exist even though it has no territory, and in this connection instances of the governments in exile during the World War II are cited. This, however, is not a true illustration because the cases of the governments in exile are merely examples of lawful governments functioning from another country during continuance of military operations. The dispossession of the lawful government by the invader pendente bello is no more than an incident of military operations. 2, record 81, English, - legal%20government

1, record 81, French, - gouvernement%20l%C3%A9gal

L'I.D.I. 1, record 81, French, - gouvernement%20l%C3%A9gal
