If it is a trial by judge alone, "apportionment of fault is primarily and properly a matter within the discretion of the trial judge... Another problem involving the use of words is the question of "conditional assault". If one person points a gun at another and says, "Your money or your life!", it might be argued that it is not assault because the plaintiff may avoid any harm by complying with the condition and parting with his money. It could be contended that the requirement of immediacy is absent. Such an argument is fallacious, however, for one cannot impose conditions upon another, when one has no legal right to do so. It would be otherwise of a landowner said to a trespasser, "Get off my land or I’ll throw you off, "for in such a case, the landowner is only threatening to do what he is entitled to do anyway. 1, record 3, English, - conditional%20assault

2, record 3, French, - voies%20de%20fait%20conditionnelles

Possession(is) a legal concept of variable meaning, the word being used in different contexts with different meanings. It denotes a kind of relationship between a person and some object of property, real or personal. It is sometimes used as meaning merely physical control or detention, without any question of legal right. Literally, a crop in the process of growth, an unmatured crop. But a disputed term in legal parlance. Some authorities hold that a growing crop may be either above or below the surface of the soil, while other authorities hold that a crop is not a growing crop unless it shows above ground, and that underground sprouts do not constitute such a crop. Again, some authorities hold that a crop is growing from the time the seed is planted until the harvest, while other authorities hold that a matured, ungathered crop is not growing. Whether grass in a pasture is a growing crop is also a controverted question.(Ballentine's, 3rd ed., 1969, p. 538) 1, record 10, English, - growing%20crop

The compulsory jurisdiction of the International Court of Justice depends upon a prior declaration of acceptance under Article 36(2) of the Statute, which reads :"The states parties to the present Statute may at any time declare that they recognize as compulsory ipso facto and without special agreement, in relation to any other state accepting the same obligation, the jurisdiction of the Court in all legal disputes concerning : a) the interpretation of a treaty; b) any question of international law; c) the existence of any fact which, if established, would constitute a breach of an international obligation; d) the nature or extent of the reparation to be made for the breach of an international obligation. "Although this jurisdiction is generally referred to as "compulsory"..., it is only compulsory once the declaration is made and within the limits of that declaration. 2, record 29, English, - compulsory%20jurisdiction

The equality of states is a general principle of international law. It is a necessary corollary of the concepts of sovereignty and independence of states. However, it is only the legal equality, or equality before the law, which is in question. States are of course not equal in fact. The general consequence is that each state is entitled to equal treatment under the law. 1, record 30, English, - equality%20of%20states

It is a much disputed question in the teaching of legal authorities and in the jurisprudence of the principal countries whether the doctrine of litispendance, the object of which is to prevent the possibility of conflicting judgments, can be invoked in international relations, in the sense that the judges of one State should, in the absence of a treaty, refuse to entertain any suit already pending before the courts of another State, exactly as they would be found to do if an action on the same subject had at some previous time been brought in due form before another court of their own country. 1, record 32, English, - litispendance

1, record 32, French, - litispendance
