LEGAL RESTRAINT [7 records]

Record 1 2025-09-08

English

Subject field(s)
  • Penal Administration
  • Offences and crimes
CONT

To summarize, a detention occurs when police either physically or psychologically restrain suspects in situations where they might require access to counsel. The category of psychological restraint may be further subdivided into two types :(i) situations where suspects face legal liability for refusing to comply with police directives; and(ii) situations where, despite the absence of such liability, they reasonably believe that compliance is mandatory.

OBS

The term detention is used when the right to retain and instruct a lawyer is triggered within the meaning of section 10 of the Canadian Charter of Rights and Freedoms.

CONT

The Peace Clause. Article 13("due restraint") of the Agriculture Agreement protects countries using subsidies which comply with the agreement from being challenged under other WTO [World Trade Organization] agreements. Without this "peace clause, "countries would have greater freedom to take action against each others’ subsidies, under the Subsidies and Countervailing Measures Agreement and related provisions. The peace clause is due to expire at the end of 2003. Some countries want it extended so that they can enjoy some degree of "legal security, "ensuring that they will not be challenged so long as they comply with their commitments on export subsidies and domestic support under the Agriculture Agreement.
